I 134 Question AGAIN

OK now we just gor the news that our potential co sponsor is no longer able to be our co sponsor due to losing his job and now going back to school....

Here's the story:

my Fiance has been with the US Army until August of last year,has then been unemployed until mid October 2005,then he had a job (with one Company) until May 2006 (lost the job bc he got laid off).Now he hasn't been back at work since May but will sign a Contarct by November 1st of this year.

(In fact he could start now but seeing that I will come to the US for a 4 week visit next month and he has to go to school for a few weeks in CA ,he can't sign the contract before November 1st.)

His new job will put us well above the 125% of the Poverty Guideline .

We will put the paperwork for the I 129 in as soon as he has his new work contact in hand so like I said in early November.

My question now is how much of a chance to we have to get our petition approved WITHOUT a co sponsor seeing that since he got out of the Militay in August of last year he has had to periods of being unemployed (one as I said 2 1/2 months and one 5 1/2 months!!!)

My nerves are shot by now and looking at the site of the US Embassy in Germany hasn't been helpful since there I can't find the info I need.

Please can someone help me??????????????????

Nat,

Financial status is not relevant to petition approval and the petition does not ask for employment information.

Do not submit I-129 - I suspect that the petition you really want to use is I-129f.

The reason why I was wondering,actually why I'm so worried is bc on the G 325a he will have to list his past employers and he has those two gaps in there from August 2005 til October 13th,2005,and from May 2006 until November 2006........

And I'm worried that they will deny our petition thinking "well we can't be sure he'll hold that job....." even though now the situation is a different one and he finally found what he really wants to do even though it's not in his old (beloved) aviation field.

It took him darn long to get things staright ,I know that and like I said I do worry about the two periods of unemployment in his work history since he got out of the Army in August of 2005.

So u r saying that it will (probably) not cause problems ,right?

Nat,

Again, the petition is not concerned with the financial situation. The petition's purpose is to establish that a marriage-based relationship exists (a pre-marriage relatinship or a post-marriage relationship) so as to qualify the beneficiary to apply for a marriage-based visa.

The financials come into play with the visa application.

Don't worry about the two G-325As beyond filling them out and signing and submitting all 4 pages of each.
