I-130 pre and post approval visits?

Ok, I know I've been posting idiotic questions around..here is why, my main concern. Got my NOA1...in process..I'm allowed to visit, which I have been doing..staying a week or so at a time. CBP officer told me the last time, that once my NOA2 comes in, meaning the I-130 is approved, I'm no longer allowed to come and visit during the process until a decision is made. I have proven and successfully gone through the border on many occasions, and returned according to the rules. It just doesn't make sense to me as to why I can't visit, see my wife and my son during the whole process.

you can visit. Many people have visited after their NOA-2s. However, bring ties to Canada to show you intend to return. AND, if you are crossing at the same POE then you may get an officer of similar mind and deny you entry. All they need to say is that you clearly have immigrant intent to deny you. Denials can and do happen, remember - you have no right to enter the US

welcome to VJ! this question gets asked a zillion times on here! I'm out the door to work, but look below in my signature for feee advice!! YES one can still visit, BUT it is not a RIGHT to visit! It all boils down to the POE officer! Most have no problems, but some do! Read my signature for further info! best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Basically, the CBP officer didn't know what he was talking about. You're definitely not the first CR-1/IR-1 person who has been told this, but it is absolutely wrong. There is no law saying you cannot visit after your I-130 approved. I would suggest bringing strong prof of ties to Canada, and crossing at a different POE if possible.

I crossed through the whole process and didn't have a problem and I crossed frequently, being we lived in border towns. I just made sure I had my ties to Canada, even though I was never asked for any.

Biometrics 1/6/12 Complete

RFE 9/13/12

RFE package sent back 10/17/12

Card Production Ordered 12/04/12

10 year card arrived in mail 12/10/12

Ya, they hold me up for an hour and usually let me through...I'm in windsor, no big deal for me to get to the tunnel..15 minutes..and the ride to Ohio is 4 hours..so I'm lucky I dont get screwed on a plane ticket or nothing. What I've concentrated on is going across frequently and coming back on time like I always have..I'm sure it shows in their system..maybe a false sense of security for myself or proving myself to them to make their decision easier each time when 'that fuckin guy in the jeep' shows up, lol
