Visa case under review by the consulate

Timeline

My husband was interviewed august 6, 2010 in US embassy manila, after the interview he was asked to come back for what they called his sworn statement. My husband came back to the US embassy manila august 9, 2010. He found out that the sworn statement the consul wants him to signed was in regards to his admission of past drug use 10 years ago. During my husbands medical examination at St. Luke's he was asked if he used any drugs in his lifetime and he answered that he did for 2 years 10 years ago. My husband didnt have any kind of police record or anything but had a past history of drug use. Soon after he signed the statement, in regards to his admission, he was told that the case will be reviewed and he will be called.

Until now,we have not heard from the US embassy manila. Does anyone have the same experience? Can anyone tell us what was the outcome or if anyone can give us some experience the same as ours. We are just waiting and don't even know what to do next.

I'm sorry. I don't have any advice for the issue. This is just a good example of why you don't volunteer any information that has no documentation (from doctors, therapists, police reports, anything). If it's not on the books, then they couldn't know.

Or was his drug use documented somehow like from an arrest or something previously? Either way that sucks, sorry. :(

It looks like a complex situation for you. I am sorry to hear this. You should immediately consult an attorney now.

Here is my basic ground work and it is purely based on my opinion.

Check out Q# 40 Item a. "If an alien is drug abuser or addict are ineligible to receive a visa".

So, I strongly recommend you to meet with an expert attorney, if your beneficiary can overcome this, based on the drug use was long time (10 years) back.

I agree that you do not need to provide information that is not documented, etc
