Hi guys! I'm new to this thread, and I'm not familiar with the I-130. I filed my husband's petition last year, priority date Dec. 17, 2009. Yesterday I received the Approval Notice (yey!), NOA2???. I also checked the Visa Bulletin, and it says the cut-off date for September 2010 is Jan. 1, 2010, and that they are current. Can someone explain this to me?

If the petitioner is LPR, the visa number is not available immediately. Priority date of I-130 has to be current to become visa# available.

I'm also in the process of doing my Naturalization, hoping that after I become a citizen, I could upgrade the petition. But with the approval and cut-off dates, do you think upgrading the petition would still matter?

No need to upgrade I-130 petitioner since you already have I-130 NOA2.

What should I expect after the approval? I don't really know the steps of the I-130. What happens after this? How long do you think it will take before my husband could get here?

USCIS will transfer your case to NVC. Follow Lingche NVC shortcut to proceed in faster way. Typically 1 to 2 months to finish NVC and another 1 to 2 months for Consulate Interview.

Hi Loto! Thanks for the quick response! I have a lawyer working on my husband's papers, do you have any advise on how I could deal with NVC and lawyer? I checked the Visa Bulletin and it says they're current. Does it mean that a visa is already available for my husband, and that NVC will work on my husband's cae right away?

8/20:10: Approved/NOA2

9/03/10: NVC # generated, gave e-mail adds

9/08/10: Received IV/AOS fee bill

9/09/10: Paid AOS/IV

9/13/10: Mailed completed AOS, enetered into the system on 9/14

9/19/10: Mailed completed DS-230, entered into the system on 9/22

10/13/10: CASE COMPLETE!!!

04/06/11: Case upgraded from F2A to CR-1

05/03/11: Final review completed

05/17/11: Interview date scheduled!

05/20/11: Forwarded case to USEM

06/10/11: Interview - APPROVED!!!

You mentioned you have NOA2 of your I-130, right? If yes, that's the approval. USCIS will forward your case to NVC in 1 to 2 weeks time. You may use the lawyer, if he/she is efficient. Or if you are confident with the NVC shortcut (LingChe) that you can do yourself, you can avoid the lawyer.

NOA2 of I-130 means it is approved and visa# is ready for your beneficiary (you were LPR petitioner).
