I am a Canadian citizen who is on an H1-B visa on till the end of this month, but I recently got married to a USC and filed my AOS last month, I received my EAD Card today but I might have to travel to Canada next month. I heard that I need to file an I-130 to get back in the US, my questions are:

Is it worth it filing a I-130 or should I just wait for my interview to be approved for the Green Card?

If i file the I-130, how much will it cost?

How long does the I-130 take to get approved?

Thanks

Not sure what the cost is for an I-130 now..I paid $110 back in 2003 and I was told it could take 30 days..although mine was an emergency as my mother had just passed away so they processed it right there at the office in Denver CO...I heard they don't do that anymore..I will tell you that even with the I-130 I still had issues at Pearson International Airport in Toronto and almost missed my flight...not sure what the problem was but they sure took a second look at me

I believe you would need to file the I-131 (Advanced Parole) I-131 Instructions

I do not know how long the process takes but I believe you could ask for an expedite (see instructions) if you need to travel shortly.

You definitely do not want to leave the US while you are in the process of adjusting status.

I am sure someone with more experience with AOS will come along with more detailed info; alternatively you can post this question in the AOS forums.

Good luck!

Agree with OBX. DO NOT leave the country until you either have your green card OR your AP (advanced parole). You can file for the advanced parole now but DO NOT leave the country, you will abandon your adjustment of status and be in for a LONG journey.

OBX posted the link you need.

Good luck
