Hi Everyone,

Ive got a couple of things going on at the moment..first of all today we found out about our NOA2..great news for us however I was wondering if this is going to affect my visit to the US next week. I went thru POE ok last November after receiving the NOA1 but just wasnt sure if its going to affect anything now that there's an official approval??

Last thing...I posted this earlier on today but only had one reply...any help will be much appreciated!!!

We're confused with the whole affidavit of support issue and after reading the guides and searching for similar topics, still having no luck. We are in the process of the K1 visa and awaiting our NOA2. My fiance (the petitioner) was making above poverty level for the last three years however was laid off recently. He JUST found a new job but he wont be receiving a steady income until he gets all the necessary licenses required for his job. I am aware that he will still need to fill in an affidavit of support however, for Q7: "I am employed as or engaged in the business of ____ with ___ ...I derive an annual income of ____" will he leave this blank even though he HAD a job and had an income?

My understanding is that he will need a co-sponsor and was wondering if:

- the co-sponsor will need to complete the same I-134 in addition to the petitioner's?

- the co-sponsor will be his mother, who has filed joint taxes with his step father and have a young daughter. The mother earns less than the step father but will meet the poverty level for 3 or 4 people (will need to double check this). Will the mother (co-sponsor) need to list everyone in her household (stepfather, daughter, petitioner) as her dependents on Q8: "The following persons are dependent upon me for support" even though the step father is not dependent on the wife and the petitioner is partially dependent? Im aware that for the daughter, she will check "partially dependent".

Sorry to sound so complicated here but its just that the co-sponsor always files joint taxes with her husband and was unsure of how they would fill in the affidavit of Support.

Just posting Update ....

I just got a call from the Medical centre ... My results are all back soo Im going to head off in a bit to go pick them up .... I also rang the police about my Police Check/ Report and it was completed on the 11/2 and forwarded to the Embassy .... All Im waiting for is Shays Affidavit now ... Im praying it arrives within the next day or 2 I want to mail everything off by Friday...

Cham youll be fine! Kai should get his interview by the end of March and be heading of anytime after that :D

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Ok all I am in need of some super advice and help :)

Chris went to Visit USCIS on Friday of last week and it turns out that they have lost our file (woot!) the guy Chris spoke to said that it might be quicker for us just to re-file as it has disappeared into the blackhole that is USCIS.

Anyhow long story short we are going to put pressure on (from our end and his congressional's end) and hope that something gets found and it gets sorted.

Whilst this is happening however the plan is for me to go back to the states (ticket is booked and ETAS is approved) on the 31st of March returning on the 22nd of June. I will be taking a letter from my parents saying they expect me back (i live with them) and a letter from one of the schools I teach at saying they expect me back for work for term 3 and a copy of our NOA1. I haven't been there since June last year so I am going to start with the I'm here for a holiday (which isnt a lie) and see how things go from there, hopefully I get a nice Boarder officer.

Now I have 2 questions. Firstly anyone in here have anything else that they think I should take with me of evidence that I am returning? Or is what I am going to do probably the best set of cards I can play?

Secondly, what can I take with me to enable me to send back packet 3 if we get our NOA2 before my trip is complete? I will cut it short to come back for the medical, and interview and fingerprints, but I am wondering if i can send back all the other forms without completing those three things directly from the US?

Hi Mara,

That's crazy how you still haven't received your NOA2 yet. The first time we filed was March, but our lawyers were slow so we decided to do it ourselves. Then we filed in June/July last year..we waited for ages (but not as long as you) and we found out that they lost our file (after going back and forth with them saying that we have to wait) so we ended up re-filing in November and now have our NOA2.

I was in the states for Thanksgiving last year and I brought along with me the NOA1, letter of employment stating that I will be expected back at work on so and so date, bills under my name to be paid (credit cards), mortgage payments. I got through without a hassle and all they asked was what what the purpose of my stay and I said "for the holidays (thanksgiving)" and that was it. I will be going back there this Thursday so hopefully it will be just as pleasant as the last trip. This time I will be bringing along with me the NOA1, NOA2, a copy of the package we sent to USCIS when we filed the petition, letter of employment, bills and my pregnancy/obstetrician appointment card as I have an appointment as soon as I get back from my trip. I think what you have will get you through fine..and since they said they lost your petition then I dont see a reason why they would deny you at POE. Just bring along a couple of bills if you have any - good luck with that.

As for you getting ready for packet 3...bring along with you as much evidence of ongoing relationship and take photos while you go on your holiday...

I think what the best plan for us will end up being having to re-file and perhaps get it expedited as it was a USCIS error. But we will cross that bridge when we get there.

Please let me know how you go through the Boarder this time around, if you get through it will give me some piece of mind about doing it in 4 weeks time :)

Sadly I dont have any bills with you, I dont own a car, my phone is pre-paid and I dont own a house. Hopefully the steps I take to convince them i have work waiting will be enough.

Alternatively when they say why you are here my answer will be "holiday" nothing more nothing less unless they ask it.

Yeah, your best bet is to refile as it felt so much quicker when we did and you're right you can ask for an expedite in your situation...with ours, we never received an NOA1 so we had to refile with no expedite.

I'll definitely keep you posted on my second round attempt through POE. Hopefully I'll have enough evidence/proof of ties back here in Sydney.

You should get through with just a letter of employment and besides, you're only mentioning that you're going on a holiday so unless they probe into that, they shouldnt ask for proof of ties to your home country...goodluck nevertheless!

Ok I spoke to Chris and we are going to take your advice MzMo and refile our application next week, been a mad rush here this morning to get the forms ready to post off this afternoon. Kinda exciting the starting over bit, not so exciting with the fact that we know how long this has taken already.

We are going to attach an expedite to ours on the USCIS mistake card so hopefully it will help us getting our NOA2 in a month or 2 which would be awesome.

Hello everyone,

Im in the middle of gathering the required information for packet 3. Im also onto the medical part but do not know where to start. First of all, Im 4 months pregnant therefore will not be able to have the chest x-ray and have the vaccines done. I read in the medical instructions that I need to bring my vaccination records. My question is, is there a way I can obtain my vaccination records? Did anybody call one of the listed physicians to get a list of what vaccinations your are required to have? When I make an appointment do I advise them that Im pregnant or tell them at my actual medical interview? What usually happens in Australia if you're pregnant during the medical - do they hold off completion of the medical until after the birth THEN have the chest xray and the vaccines or does this get waived and completed prior to adjustment of status?

I don't know what happens when you are pregnant during your medical but I do know the list of required immunizations is on page 15 of the following document: http://www.cdc.gov/ncidod/dq/pdf/ti_vacc.pdf

In summary for a female adult you are required to have Tdap, MMR, HPV (ages 11-26) and Varicella (either the vaccine, or chicken pox).

I had all my shots done by my GP when I was growing up so I asked him for a list print out and I took that along to my medical. Perhaps make an appointment with your GP and see if he/she has your vaccine history on file...?

Hey MzMo .... Sorry I cant really answer your questions definately ... but I had no records of my vaccinations either ... but because of my age I was only required to do the measles, rubella, tetnus and the a booster for chicken pox I think it was ...

I think your going to have to tell them your pregnant thou because they do a urine test and I think theyre testing for pregnancy and drugs ...

Are you doing yours in Qld- Anzac Square? I saw Dr Taylor and his very nice ...

I think (plz dont take this as as 100% fact maybe someone who knows more definately can answer) they put a note on your medical with the things that havent been done yet and youll have to get them done in the states ... I dont think they will make you wait till the birth to complete the medical ...

hi ya mz

what many of us did that didnt know where or different docs did was get blood test done to find out what your ammuned to...figure out what vaccinations you might have to have according to age..

go to your local doctor and ask him to do the blood test get them put on medicare..

keep the medicare receipt...i dont know if the pathologist that takes your blood has to sight your passport or sign that they did the pathology work on you..(when i did mine i got the pathologist to sign on the bottom of the sheet about blood tests.)

when the results come in..get your doctor to print a copy for you and get him to sign it..make a copy for your own records..take these with you to the medical exam..

not sure on the fact you are pregnant thing but i doubt very much they will hold you back because of it...maybe ask this question in another thread or email the consulate...i dont think there has been any pregnant ladies go over actually in this thread..might be wrong though...

anyways just remember to take all results to your examination..it will not only save you time but also money..
