Hey guys, I just have a question...

We submitted a 129F petition Vermont Service center, we last met august 6, 2004 and we went thru a lot in our relationship well we ended up together again.:-) We sent it on August 1 (overnight fedex) and we received the NOA 1 last friday it was dated August 7, 2006

My question is are we still on the within two year period??? What date will they use the August 2 which they received the package or the august 7 (NOA 1 date).

January 17, 2011 Sent petition I-130 for my mother
February 14, 2011 Approved petition from the USCIS (Vermont)
March 02, 2011 Received letter from NVC
March 05, 2011 Payment cleared
March 06, 2011 sent the DS3032 via email to NVC
March 09, 2011 received confirmation regarding the Choice of Agent
March 10, 2011 received the IV Fee invoice via email
March 16. 2011 sent check via USPS
March 18, 2011 received e-mail regarding the IV Fee payment and the package for AOS
March 25, 2011 sent the supporting docs for AOS (DS-230 and Civil Docs)
April 15, 2011 received RFE
May 11, 2011 Case Completed
May 27, 2011 Received E-mail from NVC about the INterview Date

elizabeth - Whoa! Your cutting it close. The good thing is that you are with VSC, which seems to be more efficient than CSC. You may want to simply consult an immigration attorney and prob around in the mist of the wait. Good luck! See ya around cyberspace.

Was the NOA1 receipt/received dated august 7 or the NOA1 date. there is a difference. The NOA1 date is the date it was generated. The NOA1 receipt/receive date is the date that the petition was stamped as received and it is this date that they will go from. You have to of met within 2 years prior to the filing of the petition, the date stamped on the petition.....the NOA1 receipt/received date.

The NOA1 receipt/receive date is the date that the petition was stamped as received and it is this date that they will go from. Thanks for all the replies. Neeway my bf asked the immigration lawyer and called up somebody in the vermont service center and they said that would be no problem. They received it on August 2, 2006. Thanks guys!! and praying that the process will not be that long.:-)

Whoa, that is razor close.

As Aussiewench pointed out, if the actual paper I-797 stated August 6 2004, uh oh.

You are "technically" one day over the limit.

Although they accepted your I-129F application, there may be an RFE on the way.

With that said, can you do a quick visit to your SO in the next 60 days?

It will certainly help at the Embassy or Consulate level of the process, do it, if you can.

If you are unfortunate enough to get an RFE for evidence of meeting in the last two years, you will have really fresh evidence.

Allrighty then, the facts have been revealed.

Although a visit would not hurt your case, if possible.

Nearly two years apart may create additional questions at the Embassy, about the relationship.

That has to be he!!.

One year for me has been pure he!!, and USD6000 on the phone.

I agree as it is at the interview where it will have to be proven/shown that they have an ongoing bonafide relationship.

Well the limit twi year doesnt nessasrily means you have to meet within two years otherwise your application would be denie. in my case i have been togather for the last 5 years. we met physicaly in dec 2003. and we filed k-1 application in march 2006. so i dont know the time period of two year is deadline. it can be +- 1 years or so.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

It is a requirement of filing the I-129F that the petitioner and beneficiary have met in person within the two year period directly before the petition is filed. I am EXTREMELY SURPRISED if you met only in 2003 and not since and had your petition approved. The USCIS site is jammed packed full of denied petitions for this very reason.

The OP and her fiance met within the required two period as has already been established.

With that said, can you do a quick visit to your SO in the next 60 days?

A visit after the filing will not do any good. If you look through the USCIS appeal decisions, there are many cases where denials were given because of not meeting within 2 years and the petitioner made a trip after submission to satisfy an RFE. On appeal, the denials were upheld.
