Yes i realize that...hopefully you can get the right certification for the passport is all. You file the W-7 with the tax return. I am assuming you already filed for this year (this would be for next year since you're not already married right?) It will take you 6-8 weeks or longer to get your tax return back if you file for TIN since everything is paper filed together. I figured it wasnt worth all the hassle at the time and not being able to get a certified true copy of my wife's passport at the time. Like I said, they did not give us a stamped copy of her passport, but another sheet just verifying all the info. Would it have worked??? Probably...but I didnt want to mess with it and I wanted/needed my tax return back as soon as possible since i needed some of that money to help pay for Mhay's plane ticket.

Make sure to get your soon to be wife to sign it when you are down there.

Did I say Embassy?

look here: http://manila.usemba...wwha005.html#W7

W-7 Application

The Embassy Consular officers can authenticate originally signed birth certificates and marriage contracts issued by the Philippine National Statistics Office (NSO) (Obtaining Public Documents) in Quezon City, Philippines in support of applications for US taxpayer ID numbers, ITIN (W-7) application (Tax Assistance). Other documents required by the ITIN (W-7) may be certified by the issuing agency or official custodian of the original record.

Unfort what you will need is the passport certified and that is not a NSO document but a DFA document so this part is the part that comes into play, " Other documents required by the ITIN (W-7) may be certified by the issuing agency or official custodian of the original record."

You got back what Trisha got back which was a receipt and a letter saying the info is correct on DFA letter head. We used that when filing and had no issues getting TIN when we filed the W7 with the 1040. Yes it was paper and it total duration it took about 5 weeks to get the TIN processed and then about 2 weeks for the 1040 to be processed and the refund deposited into our account. It was a bit of a pain due to the extra steps so that we could claim Trisha as a resident (she was still living in Phil). See IRS Pub 519 on how to do that. Plus there are many threads on that subject. Overall I would do it again.

Yeah, but it didnt look too official to me,(glued picture on the paper??...yes I know they had a seal on it over the picture) so I just opted to go ahead and file electronically...now I will file my ammendment. I still have to paper file that, but at least I already got the bulk of my return.

To the OP I have been thinking about something.....Is your soon to be wife going to change her name and passport to your name before getting her visa to the US? Mhay renewed her passport with a name change and it took about a month to get it back (she had less than 2 years left on the current passport). Granted, you can still do this without changing her name in the passport, but I would think it would look better and be easier in the long run. Just something to think about.

Yes I told her that she will change everything to her married name since I am going to open bank account in the Philippines. All the paper work will filed in her marraied name.

I hope you have better luck than I did trying to open an account down there. They told me no...might have been the bank though, but who knows. Just make sure to get a couple copies of the W-7 signed by your soon to be wife. Then you will only wait for the marriage certificate (I am assuming you will be getting married on a trip soon). It is kinda a pain to do and get everything. So if you arent already married and your wife already have her name changed in her passport, it will be a little while for the DFA certification (although, I suppose you could still use the maiden name passport for the TIN if needed)

I always hate the different answers I get from people when I was down there...most of them just wanted you to persuade them so you could get the anwser you were looking for. Dont fall for that though...sometimes they will screw you in the end (well actually most of the time)

I agree with all the name change stuff being done there...it is a lot easier especially once she gets to the US...

Have a safe trip there and let us know how everything works out.
