Options while awaiting K-1 approval

Timeline

I was curious if anyone knows what options there may be for us to be together while awaiting approval of the K-1. I assume none as they use the passports, etc

Perhaps the USC going to Russia? Or both parties meeting in a third country? :)

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Timeline

Have you had your interview and thats why they have your passport? If so then you should be getting your passport back within a couple weeks anyways then you are free to make the move.

See profile for our K-1 Visa/AOS story from 2010-2011Apparently we love USCIS/NVC so much we left and are doing it again! This time giving IR-1 a whirl. Rock on immigrators.

07/09/2014 sent in IR-1 packet to Chicago Lockbox

07/16/2014 NOA1

07/17/2014 check cashed by USCIS

10/01/2014 found out we are expecting baby #2 June 2015!

12/15/2014 NOA2

12/30/2014 Case received by NVC

03/23/2015 Received Case and Inv # from NVC after many calls and bogus excuses.

03/24/2015 AOS payment accepted by NVC

04/09/2015 IV payment finally accepted by NVC after the set the wrong fee and took weeks to correct it.

*many more delays thanks to the agency processing my fingers prints to the RCMP and the post office losing our mail*

05/20/2015 Packet sent to NVC via UPS, eta May 28.

06/16/2015 Baby #2 due - homebirth in Scottsdale, AZ

No, just starting the process and trying to cover all the bases regarding questions we have. Sucks to be apart for 6 months. I am in Russia with her now but time is slipping by... :(

I was curious if anyone knows what options there may be for us to be together while awaiting approval of the K-1. I assume none as they use the passports, etc

As others have suggested maybe meeting in another country, but if your fiance requires a visa to visit there it may be difficult to obtain or time consuming. She could apply for a visitor visa to come to the USA, however there is no guarantee that they will approve her or let her in, she would would need to show strong ties that she will be returning to Russia to wait out the k1 process.

07/13/10 - Received at NVC

07/16/10 - NVC changes embassy per our request

07/19/10 - Told we are in AP @ NVC

07/30/10 - Case sent to Cairo embassy

08/05/10 - Case received at embassy

09/07/10 - Received packet 3 - FINALLY!!!

09/15-10 - 2nd trip to Egypt, returned home on 10/5/10

12/14/10 - Received interview date

01/09/11 - 3rd trip to Egypt

01/12/11 - Interview - APPROVED!!!...but AP

01/24/11 - Returned to the states without my habibi :(

04/06/11 - AP was completed!! :)

05/10/11 - Visa has been issued!!!

What are the general requirements for "strong ties to return" and would it endanger the K-1 process in any way?

Strong ties include, but aren't limited to things such as:

A letter from her employer stating when she is expected back to work after her visit

Her name on a lease, showing she has a home in her country

Proof of enrollment in school

As stated a letter from an employer, school enrollment, lease agreement, also bank statements showing funds in her account. Anything you can think of that would prove to someone she would be returning. And no this does not endanger the k1 at all, there have been some people who have managed to get thru the borders while a k1 was in process and they had no problems getting their application approved. Also, if she is approved for the visitor visa, be sure she brings all that evidence of strong ties with her so show when she arrives because they may request that. There is also a risk of them not allowing her to enter once she arrives, although she may be approved for the visa, it is always at the discretion of the border officer to allow her to enter (not trying to scare you), but if she had strong evidence and brings it with her she should not have any problems.

Financial, social, school, utility bills, letter from employer stating they expect your s/o back to work at a certain date, children that will not be traveling with them, etc....

The more evidence you can muster up the better, but even still, the C.O. can deny for whatever reason he/she sees fit. And no, it will not effect your K-1 petition. It's a 50/50 chance, if you can absorb the $141.00 (I think thats the new price may be a little more or less) for a tourist visa.

On another note, My wife had a tourist visa before we did the K-1, she was able to stay with me during the wait, she never had a problem going through POE's @ JFK.

*This has been our experience, other ppl may have a different opinion on this, think about it, do some research and then make your decision.

Timeline

She has about 5 years of university in linguistics and teaching English as a foreign language. I was looking at the possibility of her obtaining a student or exchange visa of some kind as well.

I would like my fiance and our children to spend as much time with me as possible in the US. Our sons (5 years and 18 months, US passport holders) will most likely travel with my fiance and my father to the US as a group before she receives her K-1. I understands she must return to Italy for her appointment at the consulate there for her interview, will she have issues getting into the states while accompanying our kids? Anyone have experience in this situation?
