NVC does not have my file

I received an approval notice from USCIS on June 30 210 for my I-129F petition for my fiance. On the approval notice it stated that my case was to be forwarded to NVC where i will be issued a case number and they will contact you within 4 weeks. I called NVC and gave them my receipt number and they said they have no information on that. I called USCIS again and they said they transferred the file to NVC and should contact them. I contacted NVC again and they said the same thing, we have nothing in the system and there is no way we can track this, the only thing you can do is to email the research department and someone will get back to i did that last week and still no answer from anyone. Now i am really scared as i do not know where the file is as NVC still does not have and both USCIS and NVC say there is noway they can track that down. I have talked with the supervisor at NVC and same answer. On my orginal appoval notice it said that it is valid for 4 months.. Can someone help me please as i dont know who to contact and whom to ask where my file has gone.Thanks in advance

Ohhhhhh you're the second person out of VSC with the same NOA2 date who's file has gone missing. One of the gents who posts under the VSC April Filers thread has got the exact same problem! His has gone missing too and never reached NVC.

Here is the link to his posts, his user ID is JFV. But last I read USCIS told him he had to reconstruct his whole petition and resend everything back to them.

I am not sure if it is at USCIS or at NVC and no one is giving me any information... from any side... i guess all i can is pray

Hi jojykhan. Welcome to the club. In the past month I spoke to about 10 different immigration officers at USCIS, several supervisors at NVC. REceived numeros emails from USCIS (some suggest to contact NVC, some reconstruct my petition) and NVC (promising to follow up with USCIS). At this point I suggest you contact your congressman or senator and pray to God they have experienced people dealing with immigration. Don't listen to immigration officers at USCIS. They will only make you even more upset. NVC definitely don't have your file, talking to them will not help. I think our petitions were archived at USCIS without sending to NVC first. But that's just a speculation. God knows where they right now. I don't think reconstructing your petition without seeking help from your congressman or sentator is the right thing to do at this point. USCIS will not do anything until 90 days passed since our approval. Good luck my friend. Let me know if you hear anything. I will also keep you up to date if anything comes up. Just stay calm. I know exactly what you are going through right now.

I think I have seen some kind of thread here in VJ which can track package. Is that related to tracking package sent by NVC to US consulate abroad? I completely forgot.

10/12/10 –NVC received the file

10/15/10 -NVC case # generated

10/18/10 -Called NVC and gave both beneficiary and petitioner email addresses

10/19/10 - Beneficiary emailed DS-3032 to NVC and also mailed the hard copy

10/26/10 - Called NVC and got the IIN

10/26/10 - Paid AOS fee $ 88.00

10/27/10 - AOS fee status shows "PAID"

10/27/10 - AOS package expressed mailed (next day delivery)

10/30/10 - IV fee bill generated and paid immediately

10/30/10 - Received AOS fee bill and DS-3032 kit and also received the confirmation of receipt of DS-3032

11/04/10 - IV fee bill status shown as "paid"

11/04/10 - Sent IV package (next day delivery)

11/06/10 - Received IV instructions packet (packet 3) via email

11/08/10 - AOS entered into NVC system

11/16/10 - AOS was reviewed and OK'ed

11/18/10 - IV entered into NVC system

11/24/10 - IV package was reviewed and generated artificial RFE for missing photographs (which was actually submitted with the package)

11/26/10 - RFE response mailed out

11/29/10 - RFE response delivered to NVC

12/08/10 - RFE response entered into NVC system

12/15/10 - SIF :)

12/15/10 - Case Complete :)

01/03/11 - Interview date assigned for Feb 15 @ 1:30 PM

I went through this whole situation at the beginning of the year

We received our NOA2 on 16th February and after a month NVC still hadnt received our file. We chased from both ends and all we got was that it can take 60 - 90 days to reach NVC. NVC were more helpful allowing us to email our NOA2 so they could research it further but they confirmed back by email they had not received our case and it was still at Vermont. So we were patient and waited till the deadline of 60 days and finally managed to get a supervisor at USCIS after lots of emails and phone calls it was very stressful! She researched into the case and after a week we received an email from USCIS confirming they had lost our petition and we had to resend a whole new on (luckily I had kept copies of everything) but it does mean reconstructing then sending to your SO for them to sign etc etc. So finally she confirms she has received the new case and they allocate it the same EAC number. Then after a a week my SO receives the duplicate file back stating they had found our original case!! :bonk:

Again we wait....finally we receive an NOA2 date of 20th May and then our case took another three weeks to get to NVC. In between this we did chase again and this was with having the supervisors name and direct number. At one point they thought they had misplaced the file again!!

My advise would be to get in touch with your congressman as at least if they can confirm sooner that USCIS have misplaced your file you can get another one sent in asap instead of waiting the 60-90 day deadline they issue from USCIS.

NVC will take care of you. You have to wait a while since it takes time for NVC to contact USCIS on your behalf. Good luck!

It seems like you had similar issue. Looking at your timeline it took USCIS one month to send your petition to NVC. Please share your experience with us. Who did you contact and how long did it take NVC to get back to you? NVC responded to me via email a week ago that they will contact USCIS on my behave.

i went to my congresswoman but the reply i got from NVC was faster than the congresswoman's office. so, it will take two to three weeks to get a response. good luck.
