How long before denied application is returned to DHS

Hey guys, another thing. Does any body have an idea how long it would take the Lagos Consulate to return a denied k-1 visa application to the DHS? When they decide they'll return your application to DHS for a possible revocation, do they do that immediately or wait for how long before they drop it in the mail for a return?

Lagos is hard to deal with. Our first petition the interview was early August and they claimed immediately after that it had been returned to USCIS and couldn't be reviewed there and it wasn't back in the US for 3 months. We may be the extreme case.

This will not be over quickly. You will not enjoy this.

Snap!!! That is troubling. Did you contact your senate representative for that while it took that long?

I was so hot about the rejection I contacted more than my representative. The original CO wanted him to tell her details of what I do at a classified job. Not the name of the company , not the job title, not the general type of thing I do, she wanted details. I ended up filing an attempted espionage report which probably didn't speed the process up but I was required to report such attempts to extract information.

This will not be over quickly. You will not enjoy this.

Jeez! This does not inspire my confidence in my representatives at all. So I guess the COs can still be hard headed with the representatives as well.

2011-02-25: POE - JFK (New York City)
2011-03-14: Received Conditional Green Card
2011-04-01: Received SS Card
2012-03-25: Our son is born!

Wow! this is really frustrating! Sending a mail should only take a max of 3 weeks. I guess with your confirmation of the first responder's transit time, I'll have to wait about 3 months as well...really hope there are folks out there that had a much shorter time, to give me hope.

August 2006: Approved for Dual Citizenship from the German Consulate

I am officially now a Dual Citizen :)))

07.06.09 sent I-129F to Vermont Service Center for Mr Brazil

07.09.09 NOA1

12.11.09 NOA2

02.23.10 Visa Interview - Rio de Janeiro-Visa denied

03.11.10 case cent back to VSC

Second Round:

04.19.10 Sent new petition to Vermont Service Center

04.21.10 NOA1

04.23.10 check cashed

07.16.10 touched

10.XX.10: Decide to split with my fiance and set in a withdraw letter to VSC

10.25.10: NOA2 - to my surprise but it does not matter anymore

11.18.10: Withdraw of my petition is final - The End of my Immigration Journey :)

I think one reason they hold on to it for 3 months is to make sure it is expired when it gets back. That way it takes forever to come to the top of the review pile and they will send a message that the petition is expired after you wait 6 months.

Looks like yours took less than a month from the denial date to the date it was received at VSC. How is that 3 months? With the look at your timelines and stuff I don't think you went through the Lagos Consulate.

You don't have to wait for a decision to file again. If you know you are going K1 again just assume the first petition is expired, state that in your cover letter and then submit a new one, heavily front loaded

For my case, I can't tell if the USCIS would require me to file a K-3 or reapprove my K-1. How long does an original filing take before it expires? If I my petition is reapproved, it is anew right?

They expire 120 days after their initial approval. Usually Lagos interviews after that so in theory it expires sometime about 120 days after the interview. They sit on it about 3 months then a month in return processing time and it is expired when USCIS gets it. Vermont can choose to reaffirm it CSC usually expires it.
