Hey guys! I won't lie... I've become a forum junkie and have gotten lazy and didn't look too far back for an answer. Pretty straight forward question:

My USC fiance is in the military and currently living in the barracks. We will not be provided funding for housing until we are married. We are going to be put on a waiting list for housing soon but more than likely will not get it until we are married, and even then it may only be a month or so afterwards. What do you recommend? How do we present this info... I assume we'll need to rent a place or something for the first month but cannot use that as evidence since there will be no long term lease.

If your fiance was in the military, what did you do/provide to the consulate?

As you are doing a K-1 Visa you don't have to prove domicile since the initial petition was filed from the US.

12/31/2009 - Marriage

07/21/2010 - AOS approved

08/04/2010 - Green Card received (and it's actually green!)

05/30/2012 - Sent ROC packet to VSC

06/08/2012 - Received NOA1 for ROC (Dated 06/04/2012)

What the eff! Then why does my packet 3 state I need it? I didn't think I did... my packet 3 also states I need DS160 and not DS156. I am getting very confused.

I think the packet like everything is kind of 'general' and they send the same one to everyone. He obviously lives in the US...he applied from the US and you're showing an affidavit of support which shows his job....again in the US. Its like the forms that you have to fill out along the way...so does a lot of other visa types so some of the questions make little sense or don't apply at all.

Like Peachey said...K-1's do not have to prove domicile so don't worry about it.

OK I won't worry about it... but I'll likely have him print something which states that married service members receive such and such benefits. Cause you know... I'm terrified :P

I just thought maybe something changed because my packet 3 has zero mention of the DS156. Thanks all!

When I went with my fiance' to the interview in Montreal in May, the Consulate Officer never asked for evidence of domicile stuff although I had printed out all sorts of things (utility bills, mortgage, etc.) Don't worry about it. Doesn't apply to K-1 visa.

My Packet 3 from Montreal asked for the DS 156 & DS 156K, i think they send out what applies to each individual case. I am bringing my daughter with me, so i presume if you have children, you will be asked for both the DS 156 & DS 156K, if you don't , you won't be asked for it.

My packet did mention evidence of domicile as well, however i agree with the others, utility bills, rental agreements, mortgage, etc is more than suffice to show that.

No children, but the DS-160 asks about children as well. Apparently it's just the new form they want and are phasing out the DS-156 or something.

No children, but the DS-160 asks about children as well. Apparently it's just the new form they want and are phasing out the DS-156 or something.

The DS 156 and DS 156K asked for more detail as per children. ( if they were coming with, if they were joining etc )

it should have been phased out a while ago from what i had read, but who knows, there seems to be a lot of confusion when it comes to Montreal :)

The packet 3 is a general packet that they send out to almost everyone (I think). Some things apply and don't apply to you.

They always say that. Just copy is id and passport, thats what i did to show his domicile in the usa. they just want to make sure he still lives in the usa i guess.
