Marry in 3 days--use married name or maiden for K3 Please What did you all do?.PLEASE reply PLEASE!

In my previous post I asked should we use Maries maiden name on the K3 process keeping in mind that she allready has her passport,police records,etc.. all in her maiden name . I am getting conflicting answers. YODRAK-Did you marry a filipino also? You seem to really know your stuff when it comes to this immigration stuff. In your case you used your wifes married name on the whole k3 process even though all of her personal documents had her maiden name on them (am I correct?) . Rob and the others had their wives change the names on their passport,etc... to their married name.NOW I AM CONFUSED. What should we do???????? We really want Marie to have my last name. I also think it would look better in the immigration officers eyes at her interview that she has my last name. But if this means that Marie is going to have to travel all over Gods creation getting all of her documents changed then we would be willing to keep her maiden name. Im just so confused at this point. We marry in 3 days and we dont know what name to put on the marriage certificate-Maiden or Married. Could the requirements be different in the Philippines than other places.Im hoping others that married a filipino woman can tell me what they did? If you have a United States recognized marriage, you can use her new married name, which is yours.

However, if the U.S. does not yet recognize your marriage, typical in the case of a K-3 petition, you must use the recognized name that your wife has now, in her country. Document specific.

I would also ask Yodrak or Aussiewench for confirmation, but this appears to be intuitive.

Hello GarynMarie,

My husband uses my maiden name in filing the petition papers. At first we are confused which name to use. Then when he get the Legal Capacity to Marry, he asked the immigration consul if I can use my maiden name he said it's ok as long as the petition papers matches all the documents specifically the passport. Basically, it's our option which name to use maiden or married name, if you want to use the married name make sure your wife's passport is change to your last name.

If she wants to use her married name (your surname) then you can do that on the K3 forms. your NSO certified marriage certificate is your evidence and it suffice everything. If she also wish to change her passport to your married name that's even better that is if she choose to. Police certificate is fine even if it's on her maiden name. I have mine on my maiden name and don't have no problem like I said they always look at your marriage cert. and birth cert. so not to worry. if she choose to use her married name she can bring her Marriage certificate Certified copy from NSO along with her birth certificate issued from NSO to passport agency so she could change it before her visa interview that way when she come here she already had your name. that's what I did on my case but again it's up to her whatever she wish to. You may certainly use your married name if you wish. We were married in cebu this year and are using the married name.

She has already her id's changed, like drivers licience, work id ect.....she already has a passport in her maiden name...but as soon as the NSO cert. of marraige comes in this week she will have the passport changed...they dont actually change the name on a current passport they place a stamp in it indicating the name change....if your wife does not have a passport yet then she can get one using her married name.

As far as the marraige certificate in the Philippines it doesnt say on there if you are using a married name or not....it just has maiden name on the certificate....once you are married you are free to use the husbands name. Just get your id's changed...some of which you can use the civil registry marraige certifate as proof of marraige to change.....however to change passpport name they require the nso certificate. You can file your I-130 and I-129f petitions using just the civil registry copy, getting the nso certificate can take a while....just have that on hand for your interview.

This doesn't make any sense.. how can the US not recognize a marriage in the case of a K-3? The marriage must be legal to get that far in the visa process.

A married woman can use the surname of her choice: maiden name, husband's name, entirely new name. A person can also use two different names; not all documents have to match.

My wife is not a Philippina. You are correct that we used my surname for her on all immigration petitions and applications that I or she submitted.

Stop thinking about what 'looks better' - it may lead you to do something inappropriate. Think instead in terms of what information does each question ask for and then answer the question that is asked without shooting yourselves in the feet by providing information that has not been asked for.

See that item on many forms that asks for other names used?

Thanks Yodrak-Your right-I need to focus only on the questions asked. I think at times I am making this more difficult than it really is. I am so concerned about making sure Marie can come home that I let my mind run wild at times. So Thanks Again-You have always been a straight forward person when helping me and others you have helped. My wife is Chinese and we were married in China she will keep her name until she gets to the U.S. then we will change her name. Why take the chance of slowing things down by doing a name change.

Keep in mind that:

Your passport must match the I-30 Visa

Your airline ticket must match your passport

Since I had a hard time changing my wifes passport in her country (because of our USA marriage) I filed the papers with her madien name.

If changing her name on the passport was easy I would have used her married name

Your points are correct, so let me add some clarifications to my earlier posts on this subject.

- All of my wife's immigration forms were filled out in her married name. Some of the supporting documentation for the immigration forms was in her married name, some of it was in her maiden name.

- My wife's passport was and still is in her maiden name. The visa placed in the passport is also in her maiden name, matching the passport.

- We do buy her airline tickets in her maiden name, to match her passport. All of her US ID and other documentary items - Green Card, Driver's License, SS card, credit cards, airline frequent flyer program, etc., is in her married name.

My sense is that it's the people who think that a married woman needs to use her maiden name for immigration purpose when she uses her married name for everything else are the ones who are confused.

Keep in mind that:

Your passport must match the I-30 Visa

Your points are correct, so let me add some clarifications to my earlier posts on this subject.

- All of my wife's immigration forms were filled out in her married name. Some of the supporting documentation for the immigration forms was in her married name, some of it was in her maiden name.

- My wife's passport was and is in her maiden name. The visa placed in the passport is also in her maiden name, matching the passport.

- We do buy her airline tickets in her maiden name, to match her passport. All of her US ID and other documentary items - Green Card, Driver's License, SS card, credit cards, airline frequent flyer program, etc., is in her married name.

My sense is that it's the people who think that a married woman needs to use her maiden name for immigration purpose when she uses her married name for everything else are the ones who are confused.
