FYI if you do DCF you will have to be married but this is the only way for you to not have to be apart . An earlier poster said its very quick but not really - just did mine and it took 5 months and I did the K1 once before and that took 6 so not much in it really.

Hi

Now i am confused.

As far as i know DFC is only valid to obtain a cr-1/ir-1 visa did you find a k1 visa via DFC?

That's why they said you have to be married before filing DCF.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

If you are a dual citizen, can't you just get married there? Do the legal part now then have a real nice wedding in the states later? Then you can apply DCF which normally takes 2-4 months to process. They require you to live legally in the country for six months, which you already have. You'd need to gather evidence of a valid and strong relationship, and that can be a little tough with not so much time between applying for the visa and your marriage but I think you could manage. At least you wouldn't have to be separated, but you might have to wait a little while to return to the states. Just depends on if you are willing to wait in the UK for the papers to process etc.

You can't apply for a K-1 while overseas, you'd have to return to the states and that would take 6 months to process.

You could elect for him to come over on the visa waiver program, get married, and then return to the UK with him. He is NOT allowed to adjust status to get a green card right then if you do this (you have to file a DCF or a CR1), but then you can stay together through the process.

Or you could file a K1, which takes anywhere from 4-8 months on average. You can stay in the UK if you are legally allowed to do so. Please read the guides at the top of this page :) welcome to VJ and good luck on your journey.

If you were to go about this via DCF (explained above) you would need to get married first. You cannot do DCF for the K1 fiance visa route.
