I was bit behind to catchup this thread for almost a month.

I know it is real frustration for such a long wait and some of the first few guys are slowly hitting the 7 months mark soon.

Its me again cutiezoe :)

I have a question, am just concern with my situation as a beneficiary by USC husband. I have a previous/pending US immigrant petition (Employment third preference), I am already approved by USCIS and and with a priority date of NOv 2006. Also my employer/agency already paid the VISA bill and i have a VISA number or MNL number actually I'm just waiting for the interview, but because of the RETROGRESSION that's happening on the employment category everything turns to what i didn't expected. Currently they are only processing priority date of April 2005 and I've already waited for 3 years or since 2007 for the NVC so i decided just to dumb it if ever I'll have my turn.

But my question is will it affect my husband's petition (1-130 )? Will the USCIS and NVC and US embassy or consul consider my previous petition and deny my? Actually we've argued this before and my husband told me it wouldn't affect because it's a different petition. BUt am just worried with all the delays that's happening on my papers am becoming paranoid now.

Your hubby is correct. Since one is EB and other is FB, it won't affect each other.

But, when one visa is approved, formally inform USCIS/NVC/Consulate to abandon the other.

In that situation, I would consult with an Immigration attorney. When I lived and worked in the Phils, the company I worked had a pretty good Immigration attorney in Makati, I will try to find out their contact info and pass it on.

cutiezoe, Since you're doing EB, I would presume you are in the U.S now with a valid non-immigrant employment visa.

If so, did you do con-current I-485 filing with your USC hubby's I-130 petition? Then, you don't have to leave the U.S and you will have GC here. No more NVC and Consulate hassles!

A little background which am not sure and please correct me if I'm wrong :

a. CR-1 = i'll be going to US with my marriage less than 2 years

b. IR-1 + i'll be going to US with my marriage more than 2 years

Questions:

What if i will be able to go to US using CR-1 , then after 2 years of stay i'll have my adjustment of status. When can i apply for citizenship? Will i count since i moved to US (3 yrs of waitng) or since the adjustment of status ( 5 years of waiting ) ?

Coz i think if IR-1 i don't be needing adjustment of status and automatic after 3 years of stay i can apply for citizenship?

**** I know this is to early to ask but i just want to have an answer to all the questions on my mind now.

Here is the picture.

If you use Family Based GC, you will end up with either CR1 or IR1. If the length of the marriage is less than 2 years between marriage date and POE, it will be CR1. If it is greater than 2 years, it will be IR1.

In both cases, your naturalization paper work (N-400) can be started 2 years and 9 months after POE, if you have sufficient physical and continuous residence in the U.S.

In CR1 case, you will have to do Removal of Condition - ROC (Not Adjustment of Status - AOS) after 1 year 9 months of POE, but before 2 years of POE, by filing I-751.

That's it!

cutiezoe, Since you're doing EB, I would presume you are in the U.S now with a valid non-immigrant employment visa.

If so, did you do con-current I-485 filing with your USC hubby's I-130 petition? Then, you don't have to leave the U.S and you will have GC here. No more NVC and Consulate hassles!

and by the way Loto, My employer applied EB ( third preference) and it was an immigrant visa. I'm just not aware of the forms they filed for me, but what I only knew is it is an immigrant visa. It was same VIsa my husband had before. He was also petitioned by his employer because both of us are nurses:)

Your employer applied EB based GC for you. These are the steps:

1) Employer will file a Labor certification for you with Dept. of Labor here first

2) Employer will file I-140 - employment based petition for you

3) Since you are outside the U.S, there is no Adjustment of Status. So, it will be routed through NVC to the Consulate for Consulate interview - EB based GC.

Since your PD is not current, now you are stuck in 3rd stage, but already completed first 2 stages.
