hey frinds

simply my fiancee is here in egypt now ,the embassy send to us a mail said our k1 visa case send back to usa . we got the mail by dhl says our case going back to states !!!

so we decide not to wait for it to expire or something cuse most of cases get a denial when it gets back to usa .

any way what kind of visa we need to file for after we marry and did they apply the 2 years low which said the man and woman should know each other for 2 years ???

and i feel confused about all kind of visas which depend on marriage , so please help me to choose the visa which suitable to me ,

any body need to ask me quiz about our relation to know what kind of visa we need im always here ,

any help will appreciated

06-15-2008 : my fiancee first visit to me ( stayed 3 weeks ) .

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

The law does not state that the petitioner and beneficiary must have known each other for two years. It states that they must have MET within the previous two years of filing the 129-f petition.(K-1). If you are going to marry and then refile, the I-130 or Cr-1 is the least expensive and most beneficial because it is an immigrant visa and your spouse will not have to wait to work, etc.

In order to be successful in refiling, you need to know the reason it was sent back and address those issues. There is some very good information in the MENA forum that may help you.

On a side note about marriage in Egypt. Do you plan on doing it while your fiancee is there? If so, has she been married before? Does she have her birth certificate with her? If she's been married before she will need a CERTIFIED and AUTHENTICATED divorce decree. She will need her birth certificate.

Ok skip the authenticated part. This is apparently no longer required. The divorce decree need only to be original or certified. Wish it wasn't needed when I got married!!!

Your fiance should have all her personal paperwork with her since she was there with you for your inital K1 visa interview. The CR1 is the best visa to go for.

The law does not state that the petitioner and beneficiary must have known each other for two years. It states that they must have MET within the previous two years of filing the 129-f petition.(K-1). If you are going to marry and then refile, the I-130 or Cr-1 is the least expensive and most beneficial because it is an immigrant visa and your spouse will not have to wait to work, etc.

what you mean by then refile ??? you mean do another k1 again ???

you mention i-130 ( or ) cr-1 <<<< its not the same thing i was think i need to file for i-130 and then cr1 , would you explain to me please ?

how did i know the reason they sent it back ??? i email them and call them even my fiancee go to the embassy and they said my case sent back to usa and they say we will call you and nobody call or nothing , did you know any possible way to know ?

what will happened if we marry here in egypt while our k1 going back to usa ???

The I-130 IS the CR-1. The K3 is the I-130 and I-129 COMBINED.

You do NOT have to know each other for two years prior to getting married. I knew my husband for a year and a half before we got married. By refile they mean file for another visa not the K1.

You stated that you received correspondence along with your passport stating they did not believe your relationship was valid, correct? If so, that is the reason for the denial. Get married and file for the CR-1.

No offense, but do you think it may be better for your fiancee to get involved in the Q&A? You do not seem to understand the answers you are getting.

Disregard any K-3 instructions in it, the K-3 'step' is optional. Sorry - I thought all knew this?

nobody answer us in cairo embassy , they dont need to answer nobody they bunch of jerks , all they say that the case is sending back to usa .

even me and my fiancee go to the embassy they said we had no info all we know that the people at embassy say the case going back to state !!!

did they will send to my fiancee a letter tell her why my case get cancled ???

or it will be a normal letter says they dont belive the relation without telling any info ?
