Timeline

This whole thing started after we filed for K3 visa and it got switched to CR1/CR2 visa in February and I had to submit a petition for my Stepchild.

The Petition was approved and sent to the NVC this is where the confusion started

where a signature was required i even signed as Stepfather of....

I have stated in all my documents and letters to the NVC that he is my stepchild and not my biological child.

I guess i will wait to see what the NVC supervisor has to say about this case

Everyone please keep in mind

my stepchild is here today because my Wife was Horrifically raped while she was staying at a friends during our engagement period We had originally planned to be married in Dec 2008 like we did. I had asked her the previous year for her hand to married.

I hope there is an answer somewhere...

I think the confusion started when you considered the child born to your wife during your marriage, to be a step child instead of filing a CRBA to get your child a passport. Please contact the Consulate about your situation and see if they tell you the CRBA and US Passport are appropriate for your circumstances.

I think the confusion started when you considered the child born to your wife during your marriage, to be a step child instead of filing a CRBA to get your child a passport. Please contact the Consulate about your situation and see if they tell you the CRBA and US Passport are appropriate for your circumstances.

If i was the natural or biological father of my child It would be a no brainer but unfortunately I am not the biological father to my child of this marriage And can not claim him as my natural born child. That's why for legal reasons I call him my stepchild but in real he is my SON I Love very much.

Most people applying for Visa's that get married to their spouse have kids out of wedlock already or they have kids with there american spouse. Again this is an odd case because of the rape that occurred during our Engagement and the fact that he was born 10 days after our marriage. And as his new Parents we desided to put my name on his Birth certificate out of honor to him.

When this is all said and Done i will be sure to make a post about it and i guess how to deal with this in the future.

UPdate .... Contacted the NVC today and the case is being reviewed by a Supervisor named Sue

I was asked to send an email explaining the The whole relationship and what happened. I believe they understand now he is not my biological child.

they asked me if I had adopted him yet. I answered no. Then the Guy on the other end said Then the I864W is not needed And doesn't qualify to become USA citizen upon entry to USA.

I told him that's what I have been saying from the beginning and no one was listening.

He said i believe the NVC understands know the relationship and he is your Stepchild until you adopt him at which time i we can file for citizen ship before age 18

My Wife's Paperwork is completed at NVC just waiting to Ronny's to complete

He said to call back in a week ,by then the NVC should have an answer for me. as to what we need to do to get my family here I'll give an update to this when i get final answer.

This just seems to smack against the concept of presumption of lawful paternity. I had always assumed that was a given. I guess not. Best wishes for you Ronald.

Called NVC today and was told to resubmit the I864W and on Section 3 of I864W put my stepchild's name and Sign with my Name And that nothing else would be needed on either end. No Adoption is needed. So we will wait for next step :unsure:

God I hope we get our Interview date soon after this..... :dance:

Update

We finally got the Documents completed at the NVC. on 8/18/2010 I did call the Consulate in Philippines and asked about what we will need.the lady there said the NVC would request any other documents about Ronny Jr.if there is a problem. That would be all we have to do and as long as I have notified the NVC of my relationship to Ronny Then there is no question of Immigration Fraud. Which I did notify the NVC in writing.And based on the the Administrative review was completed. So know we See what Happens at the Embassy.I will call one more time once we have the Interview date just to be sure of everything.

PS

I did contact an attorney in the Philippines and he said if I did need to adopt before he comes to the USA it would take 7 to 9 months to complete the adoption process and $1700 in fees. I think I covered all my based Just In case.

Well new update

We finally have the documents completed at the NVC and Our Interview date Set for October 5th at 830am

The letter stated No adoption papers are needed

So it looks like we got everything right for this one

I will be there at interview for total support of my family :innocent:

I will be reporting back of the interview and how that went

Looking for some strong Prayers from you all

Well All is good

We went to the interview ready for a really long one, but The Counsular Officer looked at the Birth certificate and said

1. You were married Dec 8th 2008 ?

Yes

2 Your Son was born Dec 18th 2008 ?

Yes

3. When was first time you meet your wife?

Nev 23 2008

4. Could you please explain why your Name is on his birthcert?

Yes sir

Because he was born after we were married

5.Could you explain his relation ship to you

Well sir, I believe he would be considered my stepchild because i am not his biological father

5 Would you put that in writing for us so there is no misunderstanding?

Yes sir

After Writing this document explaining the situation He reviewed and Said Well... everything looking like its in order..Your Visa's are Approved !!!!!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
