Filing I-751 jointly while we are living separately

Oh, I am so sorry, I didn't know I had to write how long we have been together,

how much we still love each other, the reasons why I got separated from my husband,

how hard I tried to fix being separated and everything.

However I still won't write about them yet because it's just my problem and

I'm not asking someone in here to fix that.

I posted the questions because in case everything I am trying now won't be working out.

Does anybody understand what I'm really questioning?

Please do not waste your time to post the comments or answers I'm not asking.

In that case, based only on the information you DID provide,the USCIS would deny removal of conditions to your GC. Why? You used your visa to come here already knowing that you would not have a bona fide marriage. You have not had a real marriage since arriving here; even a divorce will not help you get your permanent green card. It's sad.

No judgments here but if you have 18 months before you have to file ROC anyway and you're still married why not try working it out with your husband to get back together? By the time it comes for ROC you may have reconciled.

Im sorry, and I understand that this is a site for help with forms and support, but I dont get it.

Why would anyone in there right mind, spend so much time, money, effort, heart ache into this process ... get to the USA, give up everything they have ever known, -- job, family, friends, home --- be with their partner, split up within a couple months ... and actualy WANT to stay in the US ???

If after years of my relationship with my fiance, and another year in this process, and I got to him ... if it didnt work out .. I would be heading right back to Canada.

Maybe this isnt the place for this kind of post, but it really doesnt look like " love " to me, and I just see this kind of posting so so much, I had to say something.

the reason it is so hard, costs so much money, and takes so long to get a visa is because of visa fraud.

people will pay $50,000 to do a fake marriage, get their GC, and divorce etc.

that is why all the people who are legit have to take a hit to prevent stuff like that.

it is terrible, and i am sad we all have to feel the pain because of it. :angry:

If you really want to give a shot, you could. But if you would like to be prepared for the worst case scenario, you should and that is probably what you are going to face. The reasons are very simple. You can not fool USCIS. They know everything, and they can easily find out about "living separately" and not sharing anything. As an initial process, they will do a background check, and everything will be revealed. Do NOT underestimate USCIS. Do you share any financial resources & assets & debts with him? If you don't, I don't think USCIS will take you seriously, and it will look very suspicious. Take a look at all the evidences you have to submit. Do you have these hard evidences at this moment? USCIS expect you submit 2-3 yrs of information.

You are in a very difficult position. Since you came into this country with CR status, unless you manage to find a way to get condition removed, your status will not be extended. Also, you'll have no chance of getting non-immigrant status-F or J or H visa. Divorce will not help your situation, unless he has some problems.

Living in the US is everyone's dream. But staying in this country is not as easy as you would hope. It is getting harder and harder every year. Entering into this country with legitimate status is getting harder and harder every year, but staying in this country "legally" and keeping the legal status is equally hard. It is really a serious matter, and you should really take it seriously.

I have already posted here for a case where a couple did not live together prior to filing I-751 jointly but they had a lot of proof to show that they are still together. One of my friends' relationship didn't work cause his wife cheated on him and delivered a baby from a different father and He left her. Anyway before the time he was supposed to file I-751 they worked it out and he decided to file jointly. I helped him assemble his I-751 package. The had ID's on the same address even she was not living with him, bank accounts, credit card, car insurance, heath insurance which he had made when they were still together and I know that he liked her but she is a bi***. He got approved in less than 3 months so I don't know what to say. It was a hard process for him. I know I went through the same thing but I am a citizen and I still happily live with my wife now.
