My I-130 petition for my wife was Approved last week. My wife had lost her birth certificate. She just found it this morning and guess what, the date of birth we used on all the I-130 and G325-A's were wrong - (off by 3 months).

Question is: Do I need to contact the USCIS about this or NVC?

If I have to tell the NVC, should I send them the original birth certificate with the letter explaining this or should I inform them of this with sending in the DS-230 (Immigration Visa App)?

06-17-2010 - NOA2

Your I-130 was APPROVED in 107 days from your NOA1 date.

06-24-2010 - NVC Case Number Assigned

Yay! I'm glad that she found it. How did you get her birthday wrong???? I'm not sure at all but I think NVC because they have your case now. You might be able to call them and correct it. If not, then def have a letter explaining with the DS230-since you have to send in the birth cert and a copy of it anyway. Good luck!

They use a different calendar, Hijri Calendar. She just translated (or converted) it to our calendar from the internet. Looking at the actual birth certificate, she notices that it STATES both dates, Hijri and our type (whatever it is called) calendar. The Hijri is fine, but our date type is wrong.

I was wondering if that was the case. Yes, just write them a letter explaining that. Since there is a calendar difference and not a "you don't even know your spouse's birthday?!?!?!" difference, you should be fine.

How do you get an I-130 approved without a birthcertificate??? Mine got held up cause I missing divorce papers from my first marriage...Seems kinda strange..Also how do you not know your own birthday???

The initial I-130 application does not ask for the ACTUAL birth certificate itself. It only asks you to fill in data into a box. As for my divorce papers, I did send CERTIFIED copies from court along with my initial I-130 application, as it WAS required and clearly stated on the instruction from USCIS.

There is a big difference between the two.

Congratulations on the I-130 approval!

If I am reading this correctly your wife is the beneficiary?

Fill in the DS-230 with her correct birthdate. The original or certified copy of her birth certificate will be required by NVC.

Any discrepancies between the I-130 petition and DS-230 form can be explained at the interview...if it even comes up. Good luck!
