ok lets see where to start, well my sweetie that i have known online for over 1 year now just online we would want to get involved with each other even more, and step it to the next level of being with each other and seems the way we are going at it most likly we will marry each other and we are fine with this ^.^

now my question is since we have had only online love and no real life contact yet, would Fileing for a K1 be a bad idea? or would her fileing for a Tourism Visa first then a K1 afterwards be the best idea here?

i'm trying to figure out whats the best thing for her and me, we really want to be with each other like most lovers. but i was reading that you need to meet them in the past 2 years? meaning have known them for the past 2 years and have met in real life in some way yes?

Anyways any advice on this is greatly thanked big time! ^.^

If the US Citizen wants to file the petition allowing the Alien beneficiary to apply for a K-1 visa, then you must have met in person in the two years prior to filing the petition. If one of you can get a tourist visa to meet the other first, it is required for the I-129F.

It makes sense no matter what.

Good luck.

Like others have mentioned, you have to have met in person within the last two years. I assume that you are the US citizen, correct? Assuming so, what country is she from? Depending on where she is from and the circumstances, obtaining a tourist visa to the United States can be extremely difficult, meaning that you would have to visit her. But I know very little about your situation.

she is from Shanghai China and yes i am a usa citizen. at the moment shes in College taking Economics, i was thinking maybe she could travel abroad and vist or another visa method if anyway possible, just as long as her and me can meet and be together within the 2years time its asking for.

ohh and we will take plenty of pictures not a problem there any ^.^ i'm sure her and me will find that easy. heheheh : 3

Without knowing anything else about her situation, I would say that obtaining a tourist visa to the United States would be unlikely. I have many Chinese friends who had to apply 3 o 4 times to get a student visa, despite being from wealthy families and obtaining a full ride scholarship to some of the top PhD programs in the United States.

In order to get a tourist visa, overwhelming evidence showing ties to her home country will be necessary, something that a typical college student is unlikely to have, although you never know. And your relationship with her would not be a positive.

Your best bet would be visiting her in China or finding a third country that would give her a tourist visa. The difficulty in obtaining a tourist visa has nothing to do with her, but rather the millions of people in the United States who applied for temporary visas to the United States and have decided to stay illegally. While I would have liked for my wife to have obtained a tourist visa, we never even tried because it simply was not going to happen given that she is from Ecuador.

If you are eligible to marry her in China (I am not exactly sure what the rules are there), you could also apply for a CR1 visa for spouses. The K1 tends to be slightly faster but much more expensive than a CR1 visa.

Don't waste your time or anybody's money trying to get a single Chinese woman a visa to visit the USA. It's not going to happen. Plan on a nice trip to China. China will certainly allow her to travel but it's the US that needs to issue her a visa and that's just not going to happen.

Right now, "the right visa" is the one you'll be getting from a Chinese Consulate in the USA, allowing you to visit China.

Oh, if she is from Shanghai, China, then pushbrk is correct. There is almost no chance she can get a tourist visa to come to the USA.

You will need to travel to China and meet here.

As others have said, document your trip thoroughly to prove with the I-129F petition that you indeed went to China and met her. Keep all used boarding passes, submit copies of your visa entry stamps, hotel receipts and finally photographs of the two of you together. If her family lives in the same area and approves, then try to have pictures of you, intended fiance(e) and her mother or father.

Good luck.
