I heard back from the Congressman on Friday...

Our K1 is dead. :(

The embassy sent the congressman a letter saying the only way we are eligible to file a waiver for his specific ineligibility is if we are married.

The K1 visa case has been closed, and the letter stated no further action could be taken...

So... Now, I got 40 days to plan a wedding! m04114.gif

Does anyone know the difference between a Marriage Certificate With Entry Number and one Without Entry Number? :blink:

I have gotten airmail in less than 2 weeks before...

I have had things take 6 weeks, and some that never reach me at all... :(

Filing OVER again, being denied, and waiting on a waiver approval, is not my idea of a good time tho :(

So, I'm sorta confused...when the K1 was originally denied, was there a visa eligibility date given? If yes, I don't understand how the waiver is going to work if the new petition u will be filing will be a CR1 since the waiver was for the K1...and if a visa eligibility date was not given, then why won't the CR1 just be approved then? :blink: I hate visa stuff--it's too confusing!

When the K1 was denied he was not banned for 3 years like you are thinking... he has 3 years clean and sober, it is the possession charges in his past that made him ineligible.

So he is not eligible for a visa at all without a waiver, and he is not eligible for a waiver of those charges as a fiance' - only as a spouse...

The good news is we can marry now and start over from there without the 3 year ban that others have had to wait out... however, we will have the waiver processing time which is at least 2-4 months after the denial at the interview...

clear as mud, eh? :wacko:
