Hello,

I'm filling up the I-130 form and I'm stuck with the immigration proceedings question #16.

When I was 14 (this was in 1998)I followed my mother to try to enter the U.S. and we got caught crossing the border ilegally. We were only in the U.S. for a couple of hours and we got fingerprinted and pictures taken. I was underage at the time so I hope it doesn't affect me much.

Does this mean that I should answer "Yes" on this question? and if so, which would be the option I should pick? Removal, Exclusion/deportation, Rescission or Judicial Proceedings?

The question itself states, "Has your relative ever been under immigration proceedings." That would lead me to believe you should answer "Yes," and check "Removal."

They have your prints and pictures, and the USCIS/INS/whatever is pretty hard-core on checking this stuff out. If you lie, you're dead in the water 100%. The instructions however ("Who May Not File" Number 6) state that if you can prove the marriage was entered in good faith, and that the marriage is valid (which you'll have to do anyways), the removal won't necessarily bar you from immigration proceedings. But, even in that paragraph, it states that "if you married your [spouse] while [they were] subject to..." Your case sounds like you didn't get married while you were being removed (unless you married at 14 lol).

I think you'll be fine. It might raise an eyebrow or two... not because they think you're a bad person, but because they may see you as another way for your mom to try to circumvent immigration laws. But, I think if you can prove the marriage is real and in good faith, you can just explain that you didn't have a choice because you were 14 years old, and I'm sure they'll understand.
