Hi everyone. I just would like to ask something about my situation. I am married to an american for almost 3 yrs now. but we have not started to process anything yet to get me to the states.. It is because my husband has no permanent work, meaning he is not paying yearly taxes because of it. I just would like to ask if his sister can sponsor me? My sister-in law is willing to sponsor but we have not started any steps yet to do this. I just would like to know and get some ideas. thank you. As of the moment, i am here in the Philippines finishing my nursing degree while my hubby is in Texas.. But yearly, my hubby visits me and stays in my place for 3-4 months. I am not rushing to get to the US but I just would like to know if his sister can sponsor or petition me.. thank you very much again. I would appreciate your answers.

I am not terribly familiar with spousal visa process but I believe that your husband should be able to petition for you with your sister-in-law as the co-sponsor for the financial support/affidavit part.

Just wanted to make the distinction that she can't actually file the petition for you.. she can just be a co-sponsor for the financial part. Your husband will be the one that will have to file.

Hope someone else who has gone through a similar process will come along here and give more info.

But I just wanted to say that I am almost sure you can do it as long as sister-in-law's income qualifies. Good luck!!!

First you need to read the VJ Guides this will inform you of what's required for your IR-1 over 3 years of marriage or, CR-1 under 3 years, at the time petition is filed by the US citizen i.e. husband. This petition will need I-864 Affidavit of Support from the US citizen your husband and 1-864A contract between sponsor and household member i.e. co sponsor.

he could file I-130 on Monday, worry about the I-864 in about 6 months -

but yes, the sister can be utilised as a co-sponser. Your husband, by the regs, is the primary sponser - is no way around that.

if your sis in law doesn't make enough money you can have multiple sponsors too!
