which visa was applied for ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

if someone is denied an immigrant visa twice, what happens next?

What does the 221g notice say, exactly? You're posting in the K3 forum about an immigrant visa. Please indicate the actual visa interviewed for.

Ultimately an actual denial followed by a revoked petition would mean you either start over or give up.

actually, the whole marriage ####### was to destroy the life of one woman for the other or lawfully wedded wife vs the mistress. The petitioner wilffuly abondoned the lawfully wedded wife or 25+yrs and within three weeks married the widowed mistress to bring her to USA under the pretense of a marriage. Is this a fraud or a criminal activity?

if the marriage is valid under the laws of the immigrant's country and the USC's state of residence the immigration will be judged on face value. the recent divorce will have some small bearing on the judgement, but will not be difinitive.

I would amend that slightly. If a legal divorce took place prior to the legal marriage then no crime was committed and the new marriage is valid. Whether the visa and green card would be issued will depend on how a Consular officer views the bona fides of the current marriage, not how wronged the former spouse may feel.

Ya, much depends on 'real divorce' and IF the divorce was finalized, a divorce decree issued.

legal divorce is implied in the legal marriage prerequisite.
