Question on Affidavit of Support

Hi all,

I hope someone here can answer this question. Can child support be included to the total household income for form I-864? I really dont want to use a joint sponsor. If I include the child support it will take me way over of what I need.

Its my understanding that yes, you can use child support.

You will likely need to provide a copy of the court order that proves the amount and duration.

Also - they may take into account how long the order for support is valid. For the I-864, its not only the current level of income but you ability to maintain that income for the required duration.

I do have the court order I also receive it in checks so I can produce as evidence. That order will be in place until my kids finish college, that is also written on the court order, at least for the next 5 years. I have survived the last 5 years and have money in my savings account.

I also co-own the home with my ex where I reside with my kids.
