I 134 Question

Ok seems like our bad luck never ends.

Just to make everyone who doesn't yet know our situation understand this real quick:

my finace lost his Job (he's been laid off) last May and hasn't found a new job for a while and will now most likeley be starting to work at a new Job September 1st.(Will put us over the 125% if you look at it anually),also will he get a Bonus (cash) from the National Guard of about 9000$.Since his Income for 2006 will most likeley not meet the 125% (not counting the 9000$ bonus) we decided to ask our friends for help and be the co sponsors.

And here it comes-

he has also been laid off last week. There's no doubt in my mind that this friend of ours will have a new job soon (Sep,1st as well I'd say).

But now both,my finace and the co sponsor will have been at the new job for only like 2 months by the time we want to put the papers in (I 129).......

Is this going to cause any problems?????

The prior years are fine for both,my man and the potential co sponsor.

Also does the Embassy in Germany (Frankfurt) require the I 134 or the I 864 for the K 1????????

Any helpful replies are more than welcome

Try and PM VJs who have gone through the consulate where you'll have your interview when the petition gets USCIS approval. Check with them what kind of documents that support the financial situation stated on I-134 the consulate is looking for. I don't see how having a job for only a few months would cause you any trouble, provided the petitioner and the co-sponsor (or co-sponsors) are 100% above (or in some cases 125% - check with the consulate) the poverty guidelines. In any case, your interview will be some months from now and you'll have this situation sorted out by then - we hope! :)

I only offer advice - not even legal. Just the plain and simple kind.

Natashabrenda,

Your fiance does not have to have made the required amount for the year 2006 - he needs to be currently making a periodic amount that equates to the required amount on an annualized basis (rate of pay per period times # of periods in a year).

And he needs to show that the job is likely to be a steady and on-going one. Appropriate words in the employer's letter would help in this regard, although employers are justifiably reluctant to make such assurances.
