K3 visa for perm legal resident ?

Hi

I am about to start the K3 application for my new wife (L) [uK citz] . I am green card holder since 1997 and do not wish to become a US citizen. All the research I have done refers to USC - is there a different application or process when the sponsor is a LPR.? Are the processing times similar or will I be a ;second class; applicant?

one other question is - I was absent from the us for the last tax year due to family berevement and thus have no US based income from that year - I know that I must prove income support for the K3 and need advice how to best present my situation to CIS - I have substancial cash assets and pensions that will be transfered to US eventually - can this be taken into account inlieu of proven income history

You have to be a USC.. no ifs ands or buts as I know.. But maybe I am wrong. Don't think so though.

The K visa is not appropriate for an LPR, but you should read the process for petitioning a spouse (advance admission V visa type) here:

As a LPR you can file the I-130 BUT it takes a much longer time to be processed, you might want to look at the timelines for the service centers that process the I-130, you would send your I-130 to 1 of the 4 service centers, I.E Cal;ifornia,Vermont,Texas & Nebraska, Texas & Nebraska would forward your I-130 to California as only they & Vermont now process the I-130, but you must still send it to YOUR correct center!!!

as for a LPR being eligible to file K3, i could'nt say, i think NOT!! but have been wrong before!!

for a LPR to file through California....the dates they are currently processing are I-130's with a receipt date of, January 1st 2005, for USC to file a I-130 the processing now dates, February 02 2006 :huh:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

There are benefits of U.S. citizenship when petitioning to bring family members to reside in the U.S. As an LPR you are not being treated as second class ... you are being treated as a noncitizen which you have chosen.

As an LPR you cannot file for K3. You can only file for IR1. Also, as an LPR you will have to wait for a priority date in category F2A for your spouse. The current priority date for F2A is Sep 99 (about a 7 year wait).

The V visa link is an old notice. The V visa is valid if the I-130 was file on or before December 21, 2000.

Only a US Citizen can apply for the K-3 Visa. If your current home country allows the dual citizenship, then being a US citizen is a good idea. A US citizen has more rights than a US Permanent Resident. I am not saying you will be treated diffrently, if you are a US CItizen VS a Permanent Resident.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
