I am preparing the I 130 forms for my new spouse. I understand I also need a separate form for her daughter. The step by step guide in completing the I 130 is for the spouse and I am not sure how to complete the process for the daughter. I have several questions were I am confused: 1) do I need a passport photo for her to include in the package? 2) Do I need a separate G-325a form for her? if so, who signs it?-thank you

1. yes.

2. yes (usually the mother signs)

make sure the child has passport, first, before filing - you'll need to throw in a passport bio page, as well (during NVC processing).

For the daughter - it's an entire new I-130 submittal - many ppl file them together (mother and daughter) in the same envelope, but keep them seperate inside the envelope somehow.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

What to include with the child's petition is included in the I-130 instructions, so study them carefully. Neither passport photos or G325a forms are needed for step children. Typically the following is included. Beneficiary = the child in this case.

- Form I-130

- Photocopy of Petitioner’s Certified Birth Certificate

- Copy of petitioner’s prior Divorce Decree

- Photocopy of Marriage Certificate

- Photocopy of Beneficiary’s Birth Certificate

Facts are cheap...knowing how to use them is precious...

What to include with the child's petition is included in the I-130 instructions, so study them carefully. Neither passport photos or G325a forms are needed for step children. Typically the following is included. Beneficiary = the child in this case.

- Form I-130

- Photocopy of Petitioner’s Certified Birth Certificate

- Copy of petitioner’s prior Divorce Decree

- Photocopy of Marriage Certificate

Make sure you send the fee for EACH I-130 petition. I made the mistake of sending the fee only for the spouse, but the fee is required for petition.

Received Checklist 9/28/2010 (said PCC not in correct format)

Case Complete 10/13/2010 ( have not received replacement PCC from wife yet to send into NVC, How can this be?) I'm not complaining!

Interview 11/08/2010

PS As of 9/11/2010, USCIS website still not updated, shows NOA-1 date and... blah blah blah. don't count on them folks.

I would use a separate cover letter for each petition. You are the petitioner. You show you were free to marry the child's mother. If the mother was previously married, show any divorce decrees for her too.

Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, copies of documents showing that any prior marriages were legally terminated and a copy of the stepchild's birth certificate.

I must confess that I overlooked the actual Instructions since they do not come attached to form!! Since my wife was never married to the father of the child I wonder if that will be an issue??? Any thoughts?

We didn't send any G-325A. All our forms have cover letters. My I-130 & Daughter's I-130 are in seperate folders but rubber band together and labeled accordingly

I don't think it it will be an issue...as long as she can prove relationship to her daughter and prove that there was no marriage that ever happened between her and the father of her daughter, otherwise she will need to submit a document showing that her previous marriage was legally terminated.

Before a visa can be issued to the child, Nicaragua's laws will need to be complied with regarding any parental rights of the father. Philippine answers don't apply here. You need to know what is needed to take a child out of Nicaragua. This has nothing to do with filing the petition though and everything to do with the Consulate end of the process.

Yes, I am aware that further down the process we will need a letter from the father. I wanted to be sure that at the first stage their would be no hiccup...thanks pushbrk

For me i never knew that we were suppose to fill another Form I-130 for our daughter,NVC sent the invoice for the $400 dollar payment and we were wondering why our daughter's was not included with mine and when we called they said we have to file another form I-130 for her.The challenge now is "are we going to interview at different times cos she's only 16th months.

If you've not filed the I-130 for the child yet - you can get some speed by using an 'expedite' process (you do this) -

and ignore the NVC Electronic Processing Stuff.

This small 'expedite' how-to only applies IF you've not yet filed I-130 for the child - and only works if 'done/included' with the I-130 submittal .
