Hey everyone, I got my I-129f petition approved but I still havent received the NOA2 yet, I believe its on its way, I know because USCIS contacted me about being approved.

Now I was just wondering when is the affidavit of support due and where do I send it? I also would like to know if I would be able to go see my fiancee and possibly stay for a vacation of about 4-5 months and while there, I would help her fill out all the forms needed for the interview and be with her at the interview. Also, how long does the visa last for?

Thanks

Sent I-129f on 02/02/2010 Wish Me Luck!

Received I-797C Notice of Action or NOA1 dated 02/10/10 on 02/15/10

NOA2 Approved May 20, 2010

From what I understand, the affidavit of support (I-134) and all required supporting documents must be sent to the foreign fiance before the date of her interview. The visa should be good for one entry into USA within a 6 month time period from the date of issuance.

The only issue is the safety of travel if you are talking about meeting her in Afghanistan. Perhaps if you are of Afghani descent as well, than that is less of a concern.

There is absolutlely no legal issue with the USC traveling to stay with his/her fiance(e) outside the US for a four or five month period if the intended destination grants you entry. It would certainly give you a very strong case for a bona fide relationship when she needs to interview at the Embassy. I would suggest not leaving the US until you know your USCIS petition has successfully arrived at the Consulate where your fiance(e) will interview. You might need to stay in the US a little longer in case something happens transmitting your file to NVC or the Consulate.

From the time the K-1 Visa is granted, the Alien beneficiary has 6 months to enter the US or the K-1 will expire. After entering the US you will have 90 days to marry and file for AOS (Adjustment of Status).

Be sure to hang on to your passport with visa stamps, keep papers or receipts of where you stay to show you have been with her all that time and take lots of photographs of the two of you together hopefully changing clothes everyday and different backgrounds visible.

If you have the opportunity to meet her family, also make sure you get photos of you two with the parents as that is very important for MOST Consulates/Embassies.

Good luck.

Thank you for the informative response. And yes I am of Afghani descent, I have gone to see her before, the first time was in 2008 when the engagement was arranged and then in 2009 when I went again for 3 months to have the official engagement, and during that time I got to know her better, so there isnt really an issue as far safety goes as I was actually there up until I was 7 years old

And hopefully I wont have any problems going there since I was a citizen of the country, now I am a naturalized citizen. Also I wont be leaving until I have confirmation that the paperwork reached the embassy and maybe even wait until an interview date is set, but I'm not sure how long that will take because I plan on leaving in 1 month if all goes well. That is also a reason I want to go is the make sure that everything goes smoothly and to be there for my fiancee at the interview to show that it is a legitimate relationship and to make sure that there isnt any mistake with all the info we have, and I will take your advice on taking pics to show them.

Thanks again!
