RFE at interview.

So I went to the Sydney consulate, and fist checked in all the documents with the gentlemen at the counter.

He took everything. looked pleased and handed it back. I also saw him stamp an approved form. He said you'll have to pack warm seeing as Chicago gets really cold. And then he said oh congratulations *big smile also*.

But then when I came to the actual interveiw things were fine until the consulate asked when i'd last seen my hubby. I explained it's been since dec2008 because firstly i got denied a visitors visa and then couldn't use the visa waiver to go visit him. And then we were waiting for the fiance visa to come through so we decided to wait on that.

Vick also changed jobs during that time so he couldn't take vacation time and then later wanted to save it for the actual wedding.

I was really nervous and I think I looked it too.

She also went out of her booth to complain to the gentelmen about the approved form in the file. *#######*

I brought maybe about six photos with me, two letters and a birthday card but she didn't take it.

initially she just wanted information that we've stayed in contact between the time we've been apart.

But on the denial form she's asked for information from 2007-2010. So I'm going to hopefully dig up phone logs from that long ago with the phone companies. We have a social networking site we use to contact each other. But we both don't keep msn logs. *deep sigh*

My ticket is for 30th of may also.

This sucks. We've waited way too long. :( :( :(

I realize that the consulate in Australia is relatively easy compared to many others, but it sounds like you were woefully unprepared for the "proof of ongoing relationship" part of the interview. If you haven't seen your fiance in 1 1/2 years, you probably should have carried in an armload of evidence to prove you maintained a strong relationship in the meantime. I don't mean to sound crass, but the evidence you brought would have been laughed at in many consulates, and I can't really fault the consular officer for not wanting to accept it.

The consular officer obviously doesn't believe either one of you are very committed to this relationship. You underestimated how seriously they take this "marriage for the purpose of evading immigration law" thing. I strongly suggest you don't underestimate them again. If there's any way your fiance can go with you when you submit your new evidence, he should make every effort to do so.

until the consulate asked when i'd last seen my hubby hubby is your vernacular usage, yes? IF the ConOff actually said 'hubby' you should have corrected him/her to say fiance. OR at least said , 'We're not married yet, we've got big plans' instead.

If indeed he/she did say 'hubby', then, IMO, was small feint designed to trip you up.

re: what they are asking for - you'll need a pile. AND write up (IMO) an evolution of relationship letter, include it in the submittal.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

6 photos, two letters and a birthday card are good when applying for the I129f petition but typically not nearly sufficient for an interview especially considering its been 1.5 years since you last saw each other.

Gather up all your records of conversation and start praying. Is there any way possible your fiance can make a visit. It may go a long way towards proving bonifide relationship. If he was there its possible it could sway their decision (still no gaurantee).

You should never purchase a ticket prior to having the visa in hand, take it from me! We were approved but the consulate had an internal issue with our case and we were delayed a month in getting the visa. I had booked tickets after the approval but without the visa in hand. A few cancellations and new reservations and a few thousand more dollars and we were all set :bonk:

Your goose is not cooked but you have some work to do to satisfy the consulate. Focus on gathering every tidbit you can to show maintained communication and relationship.

Do be cautious of the hubby word also - some consulates do try to trip you up. They asked my fiancee (now my wife) the same thing but she corrected the CO and when she did he smiled. We rehearsed the interview and she was prepared for those.

Haha but I call my fiance hubby even though we are not married, do i didn't think it really dawned on me.

She wanted me to email all the documents, which is amazing.

I think I was way too nervous and unprepared for the interview, wish vick went with me in the first place :(

were you given a 221g? or a denail? if its only a 221g, it is a conditional denial.. the condition being that you dont meet the requested additional proof of ongoing relationship... as others have said... get every bit of evidence that you can come up with... emails, chat logs, phone logs, everything.....

Sorry to hear that you had the RFE at interview. I plan on taking what ever I can find to the interview to prove our relationship. I can only imagine how you would have felt after getting comments relating to everything being approved by one person and then not getting the final approval by another after the interview. Keep your chin up and find what ever you can for the next interview.

I fully agree with Jim. I met my husband in college and we've been together for two and a half years but I haven't seen him for the last nine months. I went with an entire friggin' suitcase of evidence. Literally everything I could think of AND the kitchen sink. The same question was asked to me.

--How long have you been married?

--9 months. Will be 9 months this 17th.

--Has he visited you since then?

--"No, unfortunately, he's not been able to." She turned to look at me -- the only time she did so, the rest of the time she was busy typing on her computer.

--Why not?

--"I guess we were naive and thought we would be done in 3-4 months so we didn't really make any plans to meet up -- we didn't think the process would take so long as long as it did, and besides with both of his jobs being recent, it was hard to get time off." She nodded, and said, "yes, I understand that."

You're going to have to go overboard now and send in everything you can.

It was actually a conditional denial. Praise Jesus!

Currently calling phone companies for phone records. I digged up a few video logs we made when we were together. copious amounts of photos, screenprints of emails, screen prints of comments on the social networking site that we use, links to our profiles on the social networking site that we use.

Uh, more ideas people?

What about cards? Valentines, Christmas, Birthday, Anniversary - in a year and a half you missed a lot of occasions. e-mails spanning the 3 years? Text logs from cell phone companies. Letters from friends, family, roommates, pastors detailing the relationship, when they met the other person, how in love you are, etc. Omit any reference to 'hubby' as K-1s are for fiances, not husbands. Facebook comments? (I sent in a string of facebook messages). What about on his end, any plans made for your wedding or honeymoon - has he talked to a minister about marrying you two? I'd honestly have both of you type up a letter explaining why you were not able to meet up in a year and a half - that is certainly the reason for the conditional denial.

Also, change your flight. This is a HUGE reason not to book a flight before the visa is in your hand. Delaying changing the flight any longer may result in huge penalities.

You must be over prepared. I"m sorry this happened to you but you don't want to look back on this and say 'oh I should have...' this second time.

And as for the ticket, I was actually going to go back April 2009 - but got refused for a 12 month visa... and then couldn't use the visa waiver *I'd already purchased the ticket* So since then I've been changing my ticket since waiting for the fiance visa.

The consulate that denied my visitors visa actually suggested i go for the k1 visa. We looked into it and decided we wanted to close the distance.

And I just found out I can get phone records from two years ago. *Now I feel grateful that sometimes i was lazy and didn't use a phonecard*

I'm harassing friends to write letters detailing the relationship.

Ahh I just want to be there already :(

I dont want to seem critical but please dont use this type of "terminology" when if asked at an interview why you want to come to the US. There is no hint of loving or caring between two people in such a statement. It doesn't even sound like you have a relationship!

All I'm saying is to use and chose your words carefully - believe it or not - these CO's do listen to how and what we say very closely.

Hope everything works out and you can be together soon! Just providing some words of advice from a "somewhat wise old man".

When I had my interview, it's been 2 years since I last saw my fiance. We started talking August 2007, so I just printed one chat for each month and I had to edit some of them to make sure that each would only take 2 pages the most. Also brought with me around 12 pictures of us together, some cards he sent me and also other evidence of an ongoing relationship. The CO didn't ask anything about our meeting. For the evidences,he just asked for the pictures and a few of our chat logs.
