What am I waiting for in regards to K3 or CR1 route?

Timeline

I know alot of people on here who have had there I-130 approved keep saying there going to wait to see in regards to if there going to continue with the K3 or in fact cancel there I-129 and just go the CR1 route.

My question is what exactly is it your waiting to see, If through waiting for my I-129 to be approved my I-130 has already been transfered to London embassy then surely it would make sense to cancel my I-129 application right?

I would appreciate it if someone could just explain it to me please!

I-130 Process

NOA2 Approval recieved in the mail - 08/09/06

I-129F Process - With new form!

NOA2 arrived in mail - 08/26/06

NVC For I-129F

Arrived at NVC and Case # assigned - 08/28/06

Case Sent to London - 08/31/06

Packet 3 arrived - 09/13/06

Packet 3 Sent - 09-14-06

Medical - 09-21-06

Recieved Police Certificate - 10-03-06 (Took 34 days)

Packet 4 arrived - 10-04-06

INTERVIEW - 10-18-06 -APPROVED!

POE - Boston - 10-25-06

AOS Process

Sent AOS - 01/09/07

NOA arrived in the mail - 01/22/07

Biometrics Appointment - 02/02/07

Recieved EAD card - 04/02/07

Applied for SSN - 04/06/07

Recieved SSN - 04/16/07

AOS Interview - 06/06/07 - APPROVED

Greencard recieved - 06/22/07

Petition to remove conditions

Sent I-751 package - 03/13/09

Notice date - 03/27/09

Biometrics appointment - 04/11/09

CRIS email saying card production ordered - 07/25/09

Hiya Cape! Do you know if our case has been transferred from NVC to the consulate oversees yet??? As far as I am aware, the CR-1 sits longer at the NVC than the K-3 does. I believe it can take 2-3 months sittin there. That is why ppl opt to wait and see how the rest goes before they decide. Also, if you get over to the states on the K-3, you can still opt to follow through with the CR-1, it would just be a matter of flying back over to the UK for your interview. THat is what Ian is going to do if he gets to the states on the K-3. He will wait for the CR-1 interview. It will save the time of waiting for the AOS which can be a PITA!!!

I agree with Laura's response. If the two reach London near the same time, London will cancel the K-3 automatically. So you have a couple of choices, if you see the two are going to complete within a couple of months of one another, you can choose to cancel the K-3 & wait out the CR-1 or you can interview for the K-3, and return later to London for your CR-1. Either way you will avoid AOS. Good luck on your journey.

This is heresay -- but I have heard that you can substitute a K3 interview date with a CR1 date (heard it from a friend of a friend etc.) You could have them both ride and then call the embassy to find out if you can switch?

So you have a couple of choices, if you see the two are going to complete within a couple of months of one another, you can choose to cancel the K-3 & wait out the CR-1 or you can interview for the K-3, and return later to London for your CR-1. 2006-07-08: Self Generated DS-3032 and sent to NVC

2006-07-08: Received I-864 bill from attorney

2006-07-11: Paid I-864 bill

2006-07-12: Received IV bill

2006-07-17: Receive I-864 package

2006-07-19: Send back I-864 package

2006-07-19: Pay IV bill (was out on vacation)

2006-07-31: Sent in self-generated DS-230 (after NVC was ready)

2006-08-03: Case being reviewed by NVC (per operator)

2006-09-12: Case sent to New Delhi Consulate

2006-10-04: Emailed Consulate and got Original Interview Date (10/20/06) posponed to April 2007

Please don't go on hearsay. Go on what is to be true. Like Tim and Bethanie said, if the two reach London near the same time, London will cancel the K-3 AUTOMATICALLY! That happens with ANY consulate. The CR-1 is the grand daddy of all visas. You will not be able to subsitute a K-3 interview with a CR-1 interview.

No it does not necessarily take that long at NVC on a I-130. I have an attorney and several steps are elliminated at NVC by having an attorney, that is why I hired one. It should take less than 6 weeks.

Visa Delivered by DELBROS October 28th, 2006

October 30, 2006 Arrived back in LAX with Melinda, were going to Disneyland!!!

November 6th, 2006, Melinda and I are back home in Winslow Arizona loving Life!

If one already has a K-3 interview scheduled and the I-130 arrives at the consulate prior to.......it is up to the consulate as to whether one can do the CR-1 interview on the date that was scheduled for the K-3. Many members have done this. There are also consulates that will cancel the K-3 interview and reschedule for the CR-1 at a later date. Its totally up to the individual consulates.
