Point of Entry Question

Thank you very much for all of the information you have given me on this website. I'm sure everyone says the same thing, but it seems as if as soon as you think you have most of it figured out, another question pops into your head...it's nice to know there's usually someone on here who knows the answer! My question is about a temporary (90 day) work visa that your fiance can get at their point of entry. Are there certain airports they have to fly into to get this visa? How do we go about receiving it? My fiance is interested in doing any kind of work he can do until he receives his work visa. Any help on this topic would be much appreciated! I'm not quite sure how it works, but I've seen a few discussions on it!

The only one I've heard of that gives the temp stamp is JFK. But, keep in mind, it's only good for 90 days. IF his EAD isn't approved by that time, technically he has to have the EAD to work. Everytime I try to post something about this I get criticised so maybe someone else who is more knowledgable will pipe up and post an answer for you. Best of luck!

A cloudy issue indeed. Ask at the Embassy, after the interview.

It has to do with the stamp at the POE. Perhaps, their is information in the mysterious "envelope" that directs the Immigration Officer to stamp a certain way.

Again, ask after the interview. You could be the "trailblazer" for other VJers to gain the necessary stamp for working permission.

I was wondering about this myself ... even if one did get the temp. EAD at POE, would it expire after the 90 days? And then you'd have to wait for the EAD that you apply for with AOS? (gosh, so many acronyms!) Anyone know??

That's my understanding, too.

1. It is rumored that JFK does it, though US CIS states no place does.

2. It is good for 90 days.

3. Estimated turn around time for EAD is 75 days.

4. If you get married within first 15 days after being here and then file for EAD immediately, there might not be a break in your work.

5. If EAD is not approved when temp work stamp expires, you would need to give up job until EAD is approved.

We considered making our POE JFK just for this... however, waying the cost associated with this versus the amount of money to be made during this period. Also being considered is "sanity" of fiancee if they have to sit at home with no work and no family here. (Jerry, Oprah and Phil are not the first I want her to learn of people in America.)

I live in NY and my fiance will be flying into JFK because of convenience... there's a train station in my town that goes to Jamaica station, which has an AirTrain that'll take me straight to the JFK terminals. So if ya'll wanna wait a few months, I'll let you know if he gets it when he moves here.

If it's feasible to make the POE JFK, then go for it. If it's not feasible, I wouldn't go out of your way too much since it's only rumor and not a guarantee anyway. It's no harm to ask at the interview like William said. Does anyone know what this stamp is exactly? If the beneficiary knows what the temp EAD thing looks like and he/she doesn't get it at POE, it couldn't hurt to ask for it there, either. The worst they could say is "no" and at least you know you tried.

Hey, there's a lot to be said for NOT working immediately when one arrives. Look at it this way....the immigrant has just given up everything they know. Now they are in 'strange' land. How much culture shock should they go through at once? I believe it's wise to make some of the initial adjustments without the pressures of new employment piled on top.

I know its a pain to go without the extra income. But we ruled out a JFK entrance for the adjustment factor as well as the practical reason Eli mentioned.

And yes, even if your fiance is from the UK or Canada there will be adjustments. Trust me.

He likes to be the main financial support in our relationship, and I think it would kill him to not work for that long. If he has to, we'll make it work, but if we can get the stamp, it won't hurt! We can always get it and then decide to wait. Thanks again for all of your help! I really appreciate it.

One more question....will someone just let me know if I have the schedule of what happens next correct? Rich and I were approved July 31, and now I'm just trying to make sure I know what to expect!

1. our case gets sent to the National Visa Center

2. within 2-4 weeks they process it

3. NVC sends our packet to the embassy in London

4. London send my fiance Packet 3 (what is in here?, and how long before you get it?

5. Rich sends back what he needs to to the Embassy

6. The embassy send my fiance Packet 4 with an interview date?

Please let me know if I have this correct! This is all so confusing!!!

Correct. Between the receipt of Packets 3 and 4 he will need to arrange and complete his medical.

The contents of Packet 3 change periodically so I will defer to those who have received it recently.

I can advise you with confidence though, that the checklist sent with Packet 3 by the London consulate asks for 'expected travel date' and 'wedding date'. Don't leave those blank or you will be sent to the back of the line for your interview date.

Keep in mind that if you get the Temp EAD at JFK you still need to get a SSN before you can start work.... You need to wait 2 weeks from the date you enter the States to allow for your information to be on the SS save system it then takes about 2 weeks to get the number in the mail... so there is 28 days gone from the 90 days that you are allowed to work.... most people wait the full 90 days after filing AOS to get the EAD and you have to stop work when the Temp one expires....

Kezzie, excellent point about the SS number - which I often somehow forget everytime I read this type of thread.
