Passport Style Photo

Hi again everybody :(

My fiance sent me a passport style photo of herself, however, I didn't realize that China (where she is) has a different passport photo requirment. So the photo she sent me is narrower than the 2 x 2 inch requirements, not to mention her facial profile is larger than the (1inch to 1 3/8inch) specification.

But, since this technically isn't for a passport, do you think that USCIS will accept the photo she sent me?

If asked for a "specific" provide the specific. Don't risk this journey with hope that it works or less than specifiied. Not worth it.

I don't remember reading about any RFE's because of pictures, but it might happen anyway. I wouldn't risk it.

I only offer advice - not even legal. Just the plain and simple kind.

If it were only the SIZE of the photo itself, I'd say bring it to a photo place and see if they can adjust the size while keeping the quality of the picture somehow. But since the facial profile is also larger... I suggest seeing if she can get the photos re-done correctly.

I think you may need to have it redone. It sounds to me like you she had a 3/4 profile done...The requirement of USCIS is now full frontal. No profile. I had Laurent redo his when we discovered this demand had changed. I'm with the others who say don't risk and RFE. Just have her redo it as quickly as possible.

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

Actually let me give you the dimensions

the picture itself is 1 1/2 inch wide x 2 inch tall,

it is a front picture, but the distance between her chin and the top of her head is about 1 1/4 inch.

the distance between her eye to the bottom of the picture is also about 1 1/4 inch. So really the only thing that looks off to me is that the picture isn't 2 inches wide.

Do you think I can get away with this? It does have a white background and everything else.

I asked USCIS about this before I submitted my Brazilian Fiancee's "passport style photo". They said to cut it to the correct size 2"x2". They understand that most countries use the metric system, so photos are not of the same scale as photos here inthe US.

Take the photo to any good photo shop. Have them reprint it for you and cut to 2x2 size (have them cut, it's easier). It's a piece of cake to do it this way. Any "good" shop can do this for you while you wait. Run off 2 sheets of 6. Keep 3 spares for you at home incase something gets lost here in the US and you need to re-submit. Send her the extras as she will need them later (same size again), that way everything matches to the specs. required and she has the same with her in China for the medical and interview. (Gently write her name in pencil on the back of the pictures for her G-325A, and also for her copies of the photos before you send to her).

If after all of this you still have doubts, have her email you a high quality photo. Download it to a flash drive or SD card and bring or send it to a "good" photo shop (some you can forward the email to already attached) and have them make the passport photo this way for you. Again, let them cut it for you. They have a little hand press machine that cuts it perfect to 2x2.

The USCIS is not as picky with the passport style photos as they will be at consulate (DOS) stage. Get them as close as you can to the requirements.
