Question on I-864A form!!!!!

Hello Everyone,

I have a question on I-864A. I am the petitioner and my uncle is joint sponsoring for my spouse since I do not meet poverty guideline. Whose name should go under sponsor in I-864A form, is it my uncle or mine? and also whose name goes under household member... my uncle or his wife? please help me. currently I have it filled it out as me as sponsor and my uncle as household member.

Also in a different case, what happens if a joint sponsor is a widow. Do they have to submit I-864A form along with I-864?

More specifics are needed but the I-864 is not used in the process of obtaining a K3 visa. Please ask a real world, not hypothetical question.

does your uncle live with you? the i864 is a contract between the cosponsor, the household member and the sponsor. they live at the same address. does your uncle live with you? if he doesn't, then he has to fill out his own i864. you need to give more details about your uncle's situation.

I do not believe that an uncle can qualify as a household member for the I-864A. From the form instructions (pg 1):

Who May Be Considered a "Household Member" for Purposes of This Form?



A relative who has the same principal residence as the

sponsor and is related to the sponsor as a spouse, adult

child, parent, or sibling

The Uncle could, maybe - if the sponsor claimed the Uncle as a dependent on his most recent taxes.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
