Need Help!!! On affidavit of support I-864!!!

Hello All,

So I am at a stage where I have to fill out I-864 form. I have not filed for taxes for last 3 years because I have not worked due to finishing college. Now is it required by law that I have to fill out I-864 form even though I did not file for taxes? Also my uncle is helping me as a joint sponsor (who meets 2009 proverty guidelines) for my spouse. Is it OK for me to just submit my uncle's I-864 form and not mine?

As far as I remember it is fine, as your uncle is the sponsor he is taking responsibility for your spouse. I assume you should file a statement explaining why you did not file taxes, but yes put your uncle info as he is the sponsor.

Correct and if no taxes were filed, you attach an explanation of why you were not required to file.

Regardless of whether you earned any income or not YOU are the primary sponsor and MUST fill out and 864 and attach an explanation of why you were not reguired to file taxes... Your joint sponsor will also fill out an 864 with all the required documentation...

Thanks guys... you are so helpful!!! I will fill out the I-864 form and write a letter explaining the reason.

But do I write explaination about just last year or last three years. For last three years I have not worked or have earned anything and therefore I don't have tax return for last three years. Please tell me how many years I should write for.
