Just wondering if I can file with the 5 year requirement instead of the 3 year (to avoid having to wait on tax transcripts).

I cant answer your question regarding the 5 year, but the wait for transcripts is only 10 business days. I actually got mine quicker than that. Its not that bad.

You sure can. If you are eligible based on the 5 year rule, then even if you file with the 3 year rule, I heard during the interview some IOs will cross it out and mark the 5 year - it will make their job easier!

The 90 day rule applies so you can file now.

I would file under the 5 yr option if I were you in order not to deal with all the documentations and questions if filing based on marriage.

Why make it harder on yourself... that's my 2 cents.

Sure you can. In fact, the only reason to go the 3-year route is to become a USC as early as possible. The disadvantage is that the marriage is part of the deal. Once you are a LPR for 5 years, none of this stuff matters anymore. However . . . you still need 5 years' worth of tax transcripts.

tax transcripts can be had same day if they are faxed from the IRS. Good Luck !
