Divorce and name change for ROC

Hi everyone,

So it seems that my sweet heart from 5 years and me are going to get a divorce... We married almost 2 years ago only, after fighting for so long to be together. It really sucks, especially when we still are in such good terms.

I am filling out divorce papers right now, I guess I will ask for a restoration of my maiden name.

Hence my question:

I will try to have my ROC granted despite the fact I will be divorced. Is it going to be a problem to apply for the ROC with a different name than my current conditional GC (which is in my married name)?

Hmm. Your maiden name is still your legal name so I can't see why you wouldn't be able to apply for the ROC using it, but I'm not the USCIS.

Nah. If you have the divorce decree which states you're restoring your maiden name, USCIS will comply. Just fill in the I 751 with your maiden name as well. If you don't have the divorce decree in hand before you send the I 751, I'd include a letter stating that your divorce is forthcoming and you'd like to have your 10 year GC in your maiden name.

Hello again.

I had a look at the form i-751. If I get divorced and restore my maiden name, should I apply with my maiden or married name? Nowhere there is a question where they give the choice.

Fill the form in using whatever name you want to have on your 10 year GC.

Quoting myself from post #3 in this thread, "Just fill in the I 751 with your maiden name as well. If you don't have the divorce decree in hand before you send the I 751, I'd include a letter stating that your divorce is forthcoming and you'd like to have your 10 year GC in your maiden name."
