got shocked and need help

hi everybody,

yesterday me and my wife had an appointment to remove my conditional residence...when the interviwer called for my wife(she is the us citizen) ...the 1st thing he said to her" ur marrige is fake ...u may face 5 yrs in prison" ...she asked why? and she siad no its not i love my husband and he loves me ...then he kept asking her things ...she doesnt remmber my mother s name and happened with me too coz i couldnt remember hers mother name ...and that the only...at the end we both couldnt remember some details about us and our families but they wree like 4 things we could nt answer ....yet we provided all the documents they asked for ...tax return+rent+letters from firends and relatives+our bank account ...for me the alien the interviwer said nothing to me like ur marriage is fake or something like that ...he said ok" we ll study this and make decision in few weeks " want to mention that my wife already was married to a person from brazil yet he was residing in us ...she divoced him coz he was abusing her phisically and mentally ...she called the immigration and cancled everything coz my wife and her ex wew in the process to file for him to be legal in usa...me and her really making nice home and love each other ....please any can help me here ; what may happen to me and her ?????? for me, the interviwer was a kind of rude with her .why??? please i need answers

None of us can tell you for sure what will happen, nor can we tell you why an interviewer did what they did on any given day. But honestly, it doesn't sound good. They may deny your 10 year green card and send you a notice of intent to deny.

Personally, I'd find an immigration attorney now to prepare yourselves for possible next steps.

thank you guys...just wonna ask this:what s wrong then?...everything says that we are having real marriage ! why thEY may send an intent of deny? I m really confused...there must be proofs that this marriage is not real...if they wnna ask our landlord he is going to say good things about me and my wife ...i dont know

Again, you're asking us to predict what this officer thought and why he thought it. We have no way to know that, esp. as we don't have what you sent in your packet in front of us. I'm not sure that 'asking your landlord' is a valid suggestion, though.

Your best bet is to present to an immigration attorney exactly what papers the officer had, and for both you and your wife to write down exactly what you were asked and how you answered (to the best of your ability) in order to prepare you for possible next steps.

The ex-husband living in same house with new husband would be a red flag. Living next door or the neighborhood is a another matter as people cannot control their ex-spouse's home. It appears that living in the same household is evident of a shame/ fake marriage to this Immigration Officer. When a man or woman goes through a divorce for abuse, then marries another, having the old spouse around (living in same household) rings of polygamy... Sorry, I am trying to be hurtful but this is an old battle of the government against the Mormon's belief systems of the past.

Maybe we are reading two different threads but-

I think what the OP was saying is that the brazilian (ex) husband was already living in the US= she didn't petition for him.

I really hope you have a happy ending to this ordeal but I can understand why an IO will tell you to your face that your marriage is fake. Seriously dude, you couldn't remember your own mother inlaw's name? And your wife also couldn't remember YOUR mother's name either? don't you see anything wierd about that? At most only one of you is "allowed" to forget the mother inlaw's name. Also the issue with your wife's abusive ex-husband living with you makes it worse. An interviewer will find it difficult to believe you guys are really husband and wife given the circumstances surrounding your case. We don't know you personally so most people on here will give you the benefit of doubt but an IO will expect better from you. Get intouch with an immigration lawyer asap and get rid of your wife's ex-husband aswell. No one will take you seriously so long as he's living under the same roof with you guys.

hi i just wonna make it clear my wife ex husband is not living with us.....i never known him or met him ...my wife too doesnt know where he is ...coz when she filed divorce she has no idea where he is or how to contact him...hope its clear

Thanks for clearing it up for all. It will still benefit you to get a lawyer to sort it out with uscis. You guys made some mistakes that can be fixed. I'm sure uscis have heard more questionable things from other people than you forgeting your mother inlaw's name. Good luck and let's us know how things go.
