I am in the same situation now too. I went to USA only last July 2009 but I went back to my country after 5 weeks for some reason.

Then only last February we applied for K1 again, same petitioner/beneficary. We included a waiver with the petition and it was approved after about 5 weeks. Now I`m just waiting to schedule the interview, hoping there will be no problem.

wow only 5 weeks? That fast huh? OK, when I am ready to file another one I will include a waiver with it but not really sure what Waiver is hehe.. :D:D

The waiver is nothing but a statement of the facts and circumstances. The facts of the petition being filed for whom on what date and the A#. The outcome of the petition and the Visa process. The visa was used but there was no marriage. The beneficiary returned home. You may or may not want to explain why there was no marriage. That is the part I am not sure about.

Naturalization N-400

Our waiver was just a simple letter indicating Request for Waiver, only one page.

In the letter we indicated the details of our first K1 application.

Then just an explanation why we did not get married and had to go back home.
