Visitation while K-1 is processing?

I'm from Canada and my USC fiance is in Denver. For some reason I have it stuck in my head that I can't go visit him in the US while my I-129F is processing ( as in I'm not legally allowed to enter the US ).

Thinking back I have no idea where I got this from, but I would like to know if it's correct or not, because it is easier for me to visit him as he's in college and I'm not.

Oh good!

I wonder where I got the idea that I couldn't lol.

I'd only likely be going for a week at a time by air so no danger of overstaying the 6 months :lol:

What would be considered sufficient proof of ties? And would I have to tell customs anything about the K-1?

Oh good!

I just came back a few weeks ago from visiting my fiance ( i'm also canadian ) All they asked to see @ the POE was my return ticket .. but i did bring proof of other ties to Canada .. IE: A letter from my business partner saying i was expected back @ work such and such a day ( so a letter from your job / school ) .. a letter from my parents ( whom watched my kids ) my mortgage info .. or a lease would work .. ect ect anything you can think of that ties you to home ! If your up front and prepared you won't have any trouble crossing :thumbs:

You may not be asked to show your ties, but in most cases it's rental agreement/mortgage and a letter from your employer stating when they are expecting you back. Don't bring hard copies of your resume with you, or things which would make the POE person think you're moving.

You probably will only be asked your reason for visit and how long you're staying, but having that documentation will help in case the POE officer is having a bad day and feels like hassling you.

"In order to establish that you have binding ties to a residence in a foreign country which you have no intention of abandoning, and that you will depart the United States after your visit. . . . examples of such evidence may include: copies of bank statements from a bank in your home country, evidence of ownership of property or residence in your home country, evidence of continued employment from home country . . "

Best advice is to be overprepared - all kinds of unexpected stuff happens at the border . . .

Rule No 1.

Answer just the questions asked.

The answer to do you know the time is - yes.

I also vistited CO when on my K1, but whilst I have flown direct into DIA at that time I was going through Dulles.

My best guess: If they ask what you're coming here for, say you're visiting your fiance. If you've got the ties to your home country to prove that you're gonna go back, you have nothing to be worried of. I'm not sure if you have to volunteer the information if they don't ask, though... someone else with more experience will answer that. :)

I've visited my fiancé in the US already 5 times in the last year (2 times before filing the K1, 3 times since the filing). So far, haven't had any problems, they have never asked for any proof, they haven't even asked to see the return ticket. Just tell the truth (visiting your boyfriend/fiancé). And in case they would ask, tell them you're applying for a K1.

27 Sept 06 Medical appointment for K-1 and DCF , We now have 2 options

31 Oct 06 Authorization from Brugge to Marry

10 Nov 06 MARRIED IN BELGIUM

13 Nov 06 Filed DCF for CR1 Immigrant Visa

20 Nov 06 Received CR1 Immigrant Visa

Hi Ecalos

I am somewhat in your shoes. I am totally feeling it already... thinking that i will be apart from my fiance sucks. I have yet to apply for k1 but will be soon. I have been debating and trying to find out if spouse visa is a faster process so i can minimise the waiting time thus time apart from my fiance. But i have no answer yet. I get different answers from everyone.

Would love to visit him as much as possible before the visa gets approval as well but i get some who tell me i will not be admitted into the US. reading yr thread makes me feel much better. hope there will be no problem when i do try to visit !

if I understand correctly, that was meant as "don't overstay your Visa" since Canada is a part of the Visa Waiver Program. Correct me if I'm wrong though :unsure:
