Loss of the petitioning spouse is one of the reasons to file alone, and it works like a joker. You are not out of status and you can (and should) file once you are up to it. Your petition will be approved and you will get your 10-year Green Card right away, with one exception, which I dare to to state here, given your recent loss.

Thank you for your encouraging words, Bob, that is good to hear. I'm quite worn out and not ready for a battle.

I hope meauxna's post clarified things for you. I echo the sentiments of others - sorry for your loss. (F)

Edited to add - there's no reason to think you'll DEFINITELY be interviewed because of the death of your spouse. You might - you might not. But being interviewed doesn't mean anything bad - it's just that some people are and some aren't - even those who are jointly filing with their spouses. It's kind of a ####### shoot anymore.
