Timeline

My wife got pink yesterday. Interview lasted only about 6 or 7 minutes. We're scheduled to pick up the visa on the 30th. Thank you everyone for your answers/suggestions to my questions.

Any tips for me and my wife would be very helpful. Were you there, waiting outside for her? Was it an easier time at "the window from hell" since it came back from the USCIS for the 2nd round?

Wedding in Vietnam: 12/25/2005 (graduate school, below poverty line, couldn't apply)
[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.

Any tips for me and my wife would be very helpful. Were you there, waiting outside for her? Was it an easier time at "the window from hell" since it came back from the USCIS for the 2nd round?

Interview was a breeze this time around. Both the CO and the Interpreter were very nice and different from the first interview. The pink checklist/approval sheet was on top of all the paperwork when my wife got to the window. If you sent USCIS your rebuttal with all the evidence you have and in the rebuttal, you address all the issues from the first interview, I think you and your wife should be OK. In our rebuttal, I submitted copies of everything I had: emails, letters, phone and chat logs, text messages, money transfer receipts, etc. I also included a signed statement outlining, in chronological order, our relationship. Basically, it was our timeline with explanations of all the issues/red flags that came up during the first interview (evidence for those explanations were attached to the rebuttal package). That entire rebuttal package (mine was about 8 inches thick) was forwarded by USCIS to the Consulate (and it was sitting on the desk below the pink sheet).

I was there, outside waiting. One of the questions the CO asked was how many times I've gone to VN to visit her. My wife answered, "My husband is currently here for the seventh time and is waiting outside." I think being there do help a lot.

While waiting outside, I met a guy whose wife is a US citizen. He was there waiting for his mother who was being interviewed that day. He was denied a CR-1 a few years ago. He filed a new I-130 immediately after the first interview. The old case was reaffirmed by USCIS. He received packet 3 at about the same time for both the reaffirmed case and the new case. He and his wife wrote a letter to the Consulate asking them to drop the old case and to go with the new one. He went to the interview (his second, but in effect, it's his first, since it's on a new case). He's now on AP for over a year - he got a blue slip stating that he does not need to submit anything else. I don't know why they dropped the reaffirmed case; he didn't say. Usually, with reaffirmed cases, you will have sent them lots of evidence, which then is forwarded along with a letter from CIS stating why the case was reaffirmed, to the Consulate. I would think that the CO would have to consider CIS's letter and the evidence that is forwarded to them prior to the second interview.

I mention this because I notice you also filed a new I-130. I'm not knowledgeable in this area enough to advise you on what to do. All I can say is, if you get packet 3/4 for both cases like that guy, just think really carefully before you decide your course of action. Or seek advice for other members here. Lots of them are extremely knowledgeable in this.
