any RFE approvals been forwarded to NVC or consulate?

Hey there - I was just wondering if anybody who has gotten the re-approval (post RFE) confirmed that their case has been forwarded onto the NVC or the consulate? ? ? Mine was approved 7/13 and STILL with USCIS

I haven't heard anything from VSC (my fiance can't call from work). abcdas was told by NVC that petitions are to be sent from service centers to the consulates:

rene - that is a very good question - if yours hasn't been sent yet then we are all in for another loooooooong wait?

argh!

last i heard in vj was that petitions wound NOT be sent directly to consulates. why would they change procedure anyway?

According to the person who abcdas talked to, because NVC had already done what they needed to do the first time petitions were sent there (security checks, assigning a case number).

Exactly Mew - that's what I had heard too. I was also on the phone w/ a rep from USCIS - a helpful one who would put me on hold to dig a bit deeper as to where the case was since it had been approved July 13. She came back on the phone and said that someone there (very experienced) had confirmed that the cases are being sent back directly to the consulates. My only question is - WHY SO LONG? It has been 3 weeks and the consulate confirmed w/ me on Tuesday that they have not recieved the petition. Also what concerns me is - my fiancee had all the package 4 info completed back in May (i.e. medical check up and criminal background check)- - is it still valid?

The medical, as far as I know, is valid for a year, unless your fiance has some kind of disease that needed treatment. As for the I134, the consulate in Brazil told me they're valid for a year. You may want to check with the consulate where your petition will be sent. Criminal records/certificates validity/"expiracy" dates vary in different countries. I had to ask for another one and if the interview is not scheduled until October, I'll have to ask for yet another.

Did they tell you how long they expect it to take till they forward your case? I don't think there's anything else left for them to do on our cases. They've run security checks the first time we were approved.

No, they didn't tell me how long - just the standard, "30-90 days" response. Next Thursday (8/10) will be 30 days. I have no clue as to what they're waiting for. But it wouldn't surprise me if other cases were forwarded on -- that's why I've posted here. There's no rhyme or reason to the way individual cases are handled.

God, such a bad move to have the service centers forward the petitions to consulates. They've never had to do it before and the way things have been taking so much time to be done, I too am afraid that we'll have to wait for quite some time.

Spoke to the USCIS today about this (VSC) and asked about where the petition would go next. The person on the phone asked their supervisor and they said it would go directly to the consulate. I asked how long, they said probably a few weeks.

I'm planning to have a strategy in place to make sure the consulate does not mess up like possibly emailing them evidence of petition reaffirmation followed up with phone calls. I'm using Mexico, I doubt I will have problems but I think some other consulates may.

Have you guys started bugging the consulate down there? I would. Mew, she did not tell me any specific time so it really is still a guessing game. Good tidings!

But we are in a special category, and they did receive the cases all together. If they are sending them back with no NVC and no reason to assign a case number, I don´t see why they wouldn´t wait.

I don't think they've mailed them already simply because I got the second approval on July 13th - why would it take 3 weeks to get to the consulate? I just don't get it. FYI - my fiancee had gotten as far as having the interview sheduled w/ the consulate before the case was revoked due to IMBRA. My concern was how long the medical and criminal backgrounds were/are valid for since at this point months will have passed before the interview is sheduled again. The consulate (Buenos Aires, Argentina) told me one year for both.

Returning the petition to the consulate from USCIS will be unpredictable because:

No standard procedure involved for all consulates

Some consulates may be slower than others

They may not know what a "reaffirmed" petition is

Not all consulates may notify immediately when the petition actually arrives

All these reasons justify communicating with the consulate through email and phone. I realize even the communication aspect is diverse from consualte to consulate, some being better and more educated than others.

I, personally, don´t fear the Consulate stage, because here in Brazil they actually do a good job.

I just wonder how the hell we will know where our petitions are, after reapproved.

Also, how will they mail it? I know the Consulate in brazil mailed all the recalled cases via Fedex.

Does anyone believe that VSC will mail every single petition via Fedez? They will either wait and mail a bunch of them together or mail as they come via regular mail.

My guess...

Strange thing is, I´m still waiting for my reapproval.

Shouldn´t join this party yet.
