Hi everyone ! I just found this great forum today, i read a lot of stuff on it and it seems so useful, with a lot of people that are willing to help others, this is awesome. Here is my story and my questions about this K3 visa.Me and my American husband got married in 2006 and lived together for the past 6 years in Romania, which is where i am from.Last year he left to U.S , and we sent form I-130 in November 2009 and form I-129F in December.He than received notice that they got our papers and such.We heard nothing from them, except on the 1st of March when they sent him a request for evidence regarding our I-129F petition.I found it strange because they basically required two more passport photos from him only and form G-325A from both of us;we already sent these with the first I-130 package.What is your opinion about this?I mean both petitions are at the same center, we have followed all the steps ,it is already taking so long for them to process this,so i am just curious.We of course will send everything they asked for and pray that something good will happen very fast.Thank you and good luck to everyone!

You said that you married in 2006?

Like the person above said, ignore the RFE and go for IR-1.

You'll enter the USA with a 10 year greencard, since you'v'e been married for more than 2 years. It'll save you from having to adjust status in the US, it's also much cheaper.

Thank you all very much for your quick answers, i have heard this before that i should just ignore the K3 visa, it is too bad though, cause they used to be the fastest and easiest visas from what i heard.What happened to them?I would also like to tell you that today there are exactly 6 months since USCIS received our I130 application, and we have not heard anything from them yet.My husband will call them today to see if they are alive, i hope we will receive some good news soon.Is it normal that 6 months would pass and we got nothing from them , but their confirmation that they received our130? Does it also mean that they do not need anything else from us and all the papers that we sent were fine and enough for them ? What should happen next?Thank you all again for your input.

If it's been more than 6 months since your NOA1, I'd definitely give them a call.

The K-3s were quicker once upon a time when CR-1/IR-1 used to take years. Since that's no longer the case and there's only 3-4 weeks or so separating both, the K-3s have now been administratively closed.

Thank you for your reply.OK, i just found out that my hubby called them today and one lady there said that they are working on Oct 16th petitions right now ( which i think its BS cause i have seen around here people that applied in the same month as we did and they already received NOA 2 in Dec or Jan) and will be on ours in a few days ...they said call back in 7 days and then they will do a service request because its outside of the normal window!So pretty interesting eh ...Anyway, can you please tell me what NOA 2 would include?Thank you very much.

Respond exactly as requested, then watch your I-129F get administratively closed by NVC about a week after USCIS approves it. You may be tempted not to give the medicine to the terminal petition but if you don't respond, it will delay the approval of your I-130.

From what I heard, I used to be young and handsome but now I'm just grateful my wife's eyes are no good and she has poor taste in men. Used to doesn't count for much. The timeline advantage of K3 visas died November 16, 2006.

If your hubby called their so-called "Customer Service" number then he didn't even really speak to USCIS, but to an outside contractor with little to no information whatsoever about your petition(s). The I-130 is outside of its normal processing time. I would contact a congressperson at this point.

Thank you all for your input on my situation.Yes we know that the I-130 is outside of its normal processing time, and my hubby contacted his congressman through mail these days, we will see what happens.Also, i would like to tell you that in the autumn of 2007, i applied for a tourist visa which was denied.We were married at that time , living together in my country for 3 years but the officer stated that she did not see enough financial security so she did not grant me a tourist visa, i just wanted to travel to US at that time, did not want to immigrate.Do you think past refusal would affect our petition at this point for my immigrant visa in any way?Thank you.
