USCIS letter says petitioner doesn't meet poverty guideline?

You are just some kind of "Mr Know it ALL" aren't you??? You think I can't look on a frickin form and find "Total Income"??? Geez sorry.... we aren't so "intelligent" as you!!! I've been reading VJ for over a year and YOU seem to ALWAYS think you have the answer for EVERY thing....even when IT"S WRONG!! Just because YOUR transcript has Total Income doesn't mean EVERYONE's has it.....did that EVER cross you mind?? NO...instantly, you think your right and I must not be able to read!!! You wonder why this response seems terse..it's because I don't appreciate someone "talking down" to me like I can't read English on a form. And I know quite a bit about taxes, yet I have to hear from you telling me I can't read and I must NOT be looking at the right numbers!! If I can, I 'll scan this in and post, JUST for you!!

You have the wrong transcript. You need a "Tax Return Transcript" not an "Account Transcript". I suggest you contact the IRS and request the appropriate document.

From the 4506-T

a Return Transcript, which includes most of the line items of a tax return as filed with the IRS. A tax return transcript does not reflect

changes made to the account after the return is processed. Transcripts are only available for the following returns: Form 1040 series,

Form 1065, Form 1120, Form 1120A, Form 1120H, Form 1120L, and Form 1120S. Return transcripts are available for the current year

and returns processed during the prior 3 processing years. Most requests will be processed within 10 business days . . . . . .

b Account Transcript, which contains information on the financial status of the account, such as payments made on the account, penalty

assessments, and adjustments made by you or the IRS after the return was filed. Return information is limited to items such as tax liability

and estimated tax payments. Account transcripts are available for most returns. Most requests will be processed within 30 calendar days. .

It's a simple mistake. No apology is needed.

So, I ordered Tax Transcripts and IRS sent me something else? Well...my mistake then, and I do apologize Push.

Well..I requsted tax transcripts, that's what they sent. There were only two options given and I selected both. Also, I'm doing I-134 at the moment, not 864 (this will be later for me). My point was that, I mentioned several times that Total Income was not on the transcript that I received and was told I'm reading it wrong or basically I must be blind. I love VJ and have learned tons here, but I don't enjoy being treated like a child that can't read.

I'm going to have to back up Push here. You definitely have the wrong form. My husband called to request the form and was sent both the Tax transcript and account transcript. Give them a call and speak to them.

"IRS tax transcripts are free from the IRS, the phone number to request them is: 1-800-829-1040."

Remember to tell them "I need a tax return transcript, NOT the account transcript". It should be several pages.

With respect here is a quote from your post.

Tax Transcript uses line 37 which is actually AGI

A tax return transcript "uses" nothing. It displays line item information from a tax return, including line 22 and 37. You need a "transcript" of your tax return as a substitute for a "tax return". It's an honest mistake. Now you know what to do.

For what it's worth, it's good this came out because the consulate will not accept an account transcript as a substitute for a tax return. They need a tax return transcript.

No problem. Not really needed for the I-134 (in Australia anyway) but the returns (or IRS transcripts) will be needed for the I-864. Can't hurt to give them a call to get them started headed your way.

It's a shame but there are "government idiots" all through this process. You come across it a lot for the drivers licences and SSN's especially :S

Unless you have the actual complete returns, I would supply at least one tax return transcript and some recent pay stubs. It prevents them from asking for something you didn't provide and allows them to compare your stated income to the total income you reported to the IRS.

Yes, I do know about government idiots. I worked in the Pentagon for 10 years. Oh brother do I have some stories to tell... :whistle:

But I save all my returns every year, just a habit. Thx

Hopefully it all went well.

Something I learned here, is that you can go to your local IRS office and request tax transcripts. They print them out for you right then & there, no waiting.
