next step after I130 is k-3?

Hello. We submitted our I130 and await approval. What comes next for sure? My husband is Romanian and the embassy there is corrupt so we came to Mexico. Is it possible to make the k-3 here even though we married in Romania? Or can we do the I-R from here? We are at our wits end. The only other way people say is to marry again in Mexico and try for a tourist visa from here but I'm not sure the embassy will give one to him.

The K3 visa is dead. When alive, it required the visa be issued in the country the marriage took place. Follow the CR1/IR1 guide for your next steps. If you reside in Mexico, yes the interview can be in Juarez.

He's not going to get a tourist visa. Married is married. No need to marry again anywhere. Don't do it.

Hi Samantha! I am also from Romania, also married to an American citizen and still during the I-130 process. I read your post and i want to ask you something, that is, what do you mean and how do you know that the embassy in Romania is corrupt?You mean the US embassy?I have lived in this country forever, i know what we are dealing with but i have never heard such a thing before especially about US Embassy.If you have any kind of bad experience with the Embassy here, it would be greatly appreciated should you post it here,thank you very much and good luck.

I WAS TOLD NOT TO FILE THE K-3 VISA BECAUSE THE I130 IS GOOD ENOUGH ALONE. I FILED FOR MY HUSBAND IN SEPTEMBER 2009. GOT THE NOA OF THE PETITION BEING APPROVED AFTER 4 MONTHS. IT WAS SENT TO THE NATIONAL VISA CENTER 4 DAYS LATER. I DON'T THINK YOU SHOULD APPLY FOR THE K-3 VISA. ITS JUST A WASTE OF MONEY I THINK.

WHAT COMES NEXT AFTER THE APPROVAL OF THE I130 IS IT IS THEN SENT TO THE NATIONAL VISA CENTER FOR PROCESSING. YOU WILL BE ASSIGNED AN NVC CASE # YOU CAN CALL THE NVC AND GIVE THEM YOUR EMAILS AND EMAIL THE NVC THE AGENT OF CHOICE. YOUR BENEFICIARY NEEDS TO CHOOSE AN AGENT OF CHOICE. IT COULD BE THE PETITIONER. THEN YOU THE PETITIONER WILL NEED TO PAY FOR THE AFFIDAVIT OF SUPPORT AND FILL OUT THE FORMS AND RETURN THE DOCUMENTS NEEDED. THEY WILL THEN ASK FOR THE DS-230 TO BE PAID. ONCE ITS PAID FILL OUT THE DS-230 AND SEND IN THE DOCUMENTS NEEDED. YOU CAN PAY ONLINE IF YOU HAVE A CHECKING ACCOUNT ROUTING # AND ACCT# NEEDED @ THE IMMIGRANT INVOICE PAYMENT CENTER. YOU CAN CALL THE NVC. I UNDERSTAND ITS ALWAYS BUSY BUT YOU HAVE TO KEEP TRYING TO GET A HOLD OF IT UNTIL YOU HEAR THE AVR SYSTEM. THE AVR SYSTEM LETS YOU KNOW WHAT IS GOING ON WITH YOUR VISA. ONCE ALL YOUR DOCUMENTS ARE COMPLETE, AND NVC PROCESSED IT AND THERE WERE NO REQUESTS FOR EVIDENCES FOUND, THEN YOUR CASE WILL BE COMPLETE, AND ITS FORWARDED TO THE EMBASSY FOR AN INTERVIEW (BENEFICIARY). PLUS DONT SEND ANY DOCUMENTS IN UNLESS THE NVC ASKS FOR IT.

Please avoid posting in allcaps, as it's impolite and more difficult to read.

I recommend going the CR-1 route since you're both married. Don't worry about a tourist visa or anything, just wait for the I-130 to be approved, since it leads directly to an immigrant visa after the interview, which converts into permanent residence upon crossing into the US. Also, as long as you have your certified marriage certificate (or certified extract of the marriage records for your marriage), USCIS will be fine with that. Don't bother marrying again as that would only muddy the waters for the consular official processing your case.

The K-3 would likely be a waste of time and money.
