T4 - former canadian employer refusing to send it.

Just a thought. If you have an ROE from this employer it should show your total earning on it.

There should be a Problem's Resolution Number listed in the Blue Pages for CRA. These are staff members specifically designated to assist people with tax related problems whether they are out of the country or not. As well, you can always contact the office of your former MP - he too will have staff who can intercede on your behalf with CRA. You will have to fax them a permission statement but they can do a lot of follow up. They may well be able to report your former employer who it sounds like to me is involved in some sort of nefarious or illegal activity with his business accounting. You were paid in cash you said. Did you deposit the cash in the bank on your regular payday with enough regularity of deposits to show it was an ongoing amount? You could possibly use that to help reconstruct how much you did make and to use as 'evidence' of what you received. Good luck in getting this sorted out.

An ROE from a retail store? Never had anything of the sort before from retail.

Doesn't every employer have to issue a Record Of Employment for EI purposes when one leaves a job

Iv worked tons of retail jobs and never gotten anything like that from them, only gotten T4s

I wouldnt be surprised if they were involved in something illegal, even if it was animal/pet mills! Im going to see what it is the CRA is sending me before I contact the MP but that will be my next step.

- Spoke to my mother today on the phone and she checked all mail addressed to her (she just got back from a trip) and none of them were my T4. Still no mail for me either.

I know I'm straying from your original post about the T-4 not being issued. Just suggesting a possible way you can find out what your income earnings were.

I do agree with Kathryn, sure sound like there's something under the table going on at that place

Hm I don't know, Never filed for EI never had to but I suppose I would have to ask my former employer for an ROE and well as I stated issues about my T4 which she refuses to send ( still ) I bet the same thing would happen with her sending an ROE lol.

Well sounds like it already is the same as the T-4, because actually by law they are suppose to issue a copy of your ROE to you and send one onto the EI Commission

I had a similar problem for months with a former Canadian employer two years ago.

I contacted the CRA (I think) and told them about it and they requested it for me...

Lit a fire under that employer's @ss and I got it about two weeks later!

Inky, have you contacted the CRA again yet? I realize Liz's situation was a couple of years ago, but I can't see why they wouldn't request it again on your behalf... They'd want you to file your taxes, I'm sure.

My 2nd last employer in Canada never issued me an ROE... Whether they sent it to EI Canada who knows...I didn't ask. When I called government of canada about it they said "if you aren't applying for EI, you don't need a copy"... I'm like well that's besides the point they never gave me one & "what if" in 2008 I would have needed the ROE, I wanted it for my records as well. They told me to try contacting the employer first & if I had no success in my efforts to call them back. I have worked fast food, call centre & hotel jobs years ago that all supplied me with a ROE.

I sent my parents into my old workplace last week to pick it up, and my employer said that I had requested that they mail it to my address in Florida, so they did.

Not really sure how or where they got my address from... as I certainly didn't give it to them. A couple of folks they know received thank you cards from us for the wedding... so perhaps there. I just got the paper today from the CRA, and I have another problem.. I think it might be a big problem..

The paper says : STATEMENT OF REMUNERATION PAID and says employment income $6,316.36

Which is WELL over what I was payed.... on my deposit slip I found in my files box my final deposit gross pay listed is $5,132.62

Thats a difference of 1,183.74 that I never got paid.

Now what do I do? :wacko:

Definitely contact the CRA now, and possibly through your former MP. You need to file a complaint against your former employer, tell them that he has never issued you a copy of your T-4, that he paid you in cash and you have added up all of your deposits and there is a large discrepancy between what he said he paid you and what you received.

Do you by any chance have a record - or can put together a record - of the hours you worked? Perhaps using an old calendar on which you marked your work days? You might be able to figure out the hours you worked each week and then multiply that by your hourly wage. By law your employer was also supposed to provide you with a breakdown on each pay period of the deductions withheld from your pay - CPP, UEI, income tax and any thing else deducted. Could it be that you are accounting the net amount and he is claiming the gross amount? (Giving him the benefit of the doubt).

You can make copies of your bank statements and deposit book and calendar if you have these available and use those to support your position about what you believe you earned. CRA can certainly request an 'audit' of your former employer's payroll accounts. You should also request from CPP a statement of the deposits that were made to your SIN account this year - they should be able to provide you with that information - and if it is $0, then that is another liability against your former employer. If he has been falsifying records, then he is going to have a difficult time proving he paid you what he did since it is his word against yours. He paid you in cash, he failed to provide you with a statement of the remittances he made - and he has to make remittances to the government based upon what he paid you for CPP, UEI and income tax - and if they say he didn't make any remittances or made them incorrectly, and you claim he has also incorrectly stated the amount he paid you plus he refused, in spite of repeated requests, to provide a T-4 (looks like we know why, now!), then it looks like he may be in big trouble. The major problem with all of this is that it is going to take time to resolve and it is going to require you to push for your own best interests.

The place to start, however, is the complaint to CRA about no T-4 and bad accounting practices. The reason I suggested going through your former MP's office is that you can provide them with all of the information and documentation and then ask them to push - and keep pushing - on your behalf. If he is a good MP or if he has good staff, then they will do it.

THanks I have a calender with the hours on it, they didnt change my shedual ever and it was the same. They had us work under part time hours so that they didnt have to give benefits to anyone. It shouldnt take to long to calculate lol.
