I797 Valid From Dats

ello there,

First of all I am new to this site and have done tons of research here and on other sites. Thanks for all the help so far !!!

Ok here is my Dilemma. Back in April of 09 I applied for a K1 Visa to bring my Fiance from Colombia. I got my I-797 in the mail in September of 2009. The valid from dates are 08/31/2009-12/31/2009. I also received in the mail a letter saying that she will be receiving a package with instructions on how to schedule the interview and get all documents ready. We waited and waited and never received the package, so I decided to contact the Embassy in Colombia. They then told me to go to a website where the instructions are published because they were no longer sending the instruction packages out. I should have looked up what she needed but I recently joined the Military and I have been doing a lot of training limiting my time and I was unable to help at the time. Now my question is since the valid from dates are only until 12/31/2009 does that mean I have to reapply and re-file my I-129F ? Or will I be able to continue with this one ?

Did the Embassy/Consulate in Columbia verify they have your approved petition?

I contacted them in January to ask a question and they said

"on September 16, 2009 an instruction packet was sent to your fiancée. In order to provide better customer service, the Immigrant Visa Unit has moved all packages and forms to our website. If Ms. XXXXX does not receive the Instruction Package, please download an Instruction Package from our website and follow the detailed instructions."

Mind you this was sent after the Valid from Dates... I just sent them another email asking the same question I posted up here but I wont get a reply for a week or so because they are soooooo slow. So I would just like a little peace of mind.

You did not apply for any visa. You filed a petition, which when approved, allows your fiancee to apply for a visa. A petition is not a visa application.

You did not apply for any visa. You filed a petition, which when approved, allows your fiancee to apply for a visa. A petition is not a visa application.

pushbrk, while I find your replies normally well-thought out, informed and generally helpful, I do not see how you attempted to answer the OP's question. I found your reply overly pedantic and unhelpful.

It is not clear if the Embassy will allow you to continue and apply for the K-1 visa at this time. Please follow through with your correspondence to the Embassy in Bogota and see if they have her file and are still willing to process her application.

If so, I would suggest you dig in to the web-site, get the forms downloaded and help her start arranging for the interviews, medical, etc...

Generally speaking, an Embassy/Consulate has the authority to extend this validity period and often will do so almost as a matter of routine if any delay is not caused by either the beneficiary or petitioner.

I'm concerned that neither of you (the Embassy/Consulate, nor you guys) have done anything with this since it was received (assuming it's been nearly 5 or 6-months since they got it). I'd be on the phone ASAP to ensure your case is still there.

Except the problem here is that they didn't and it has been quite a few months now since the NOA1. Their message was that they had sent something - but she never received it. The OP is now following up with the Embassy/Consulate to see what the status of the petition is - if they have re-validated its status or if it has expired because there was no follow up. He applied for the K-1 in April, 2009, received the NOA1 in September 2009 - and there has been nothing since.
