What timeframes can we expect?

Thank you in advance for your time and advice.

I am a US citizen and my husband is a Canadian citizen working here in the US on a TV visa. Our situation is going to change dramatically soon as we are most certain that my husband will be terminated from his job within the next month.

If we would like to go the Green Card route, please help me understand a few things.

1. It looks like the I-130 is taking about 5 months to be processed. Once that is approved, can husband immediately come down to the US to live or is there more waiting?

2. After the I-130 is approved, what is the timeframe in order for him to be able to have work authorization for working in the US?

3. Can he travel from Canada to the US to visit us during the time while we have a pending I-130? (while retaining residency, etc in Canada and truly coming for 2 week visits?) As an FYI, we have a 2 year old and I can not stand the thought of him not seeing his dad for such a long time.

TN Visa Approved at Border 3-1-2013 (Canadian Citizen)

May 2014 - Completed I-693 Medical Process with Civil Surgeon

6-7-2014 Married to USC

7-15-14 Sent AOS Package via USPS Priority Mail Day 1

7-17-14 NOA for all parts of AOS package, EAD, and AP Day 3

7-21-14 Checks cashed Day 6

8-13-14 Biometrics 8-13-14 Day 28 (Did not walk in early, went on scheduled day/time)

8-27-14 Online status showed case moved to Testing and interview Day 42

9-10-14 Status update - AP and EAD approved, card production ordered Day 55

9-17-14 AP and EAD Combo Card received Day 62

10-15-14 Online status change, assigning interview date DAY 90

11-1#-14 Interview, approved at end of interview, green card should arrive in 2-3 weeks per approval letter DAY 120

11-1#-14 Evening of interview - received "Card Production Ordered" email update DAY 120 (NO RFE throughout process)

1) more time as the I-130 is NOT a visa... you still need to transit the visa application/approval process.. might be good to review the "guides" for the IR/CR process

2) Again, I-130 is not a visa... once he gets issued the visa and enters the USA as an immigrant then he is authorized to work immediately

3) sure, however, standard entry protocol/requirements still exist... if he is asked to prove "strong" ties to his home country and is unable to do that to the satisfaction of the Border Officer then he could be denied entry.

Much of the visa part of the process is user dependant (how quickly you respond to NVC information requests) and the interview schedule backlog at the respective consulate... can be done in a couple of months in some cases but more likely a little longer....

Check out the Canada regional forum as they have some long waittimes for interviews at Montreal... the 3-5 months is for part 1 which is USCIS, after that you have 4-8 weeks for NVC processing THEN the wait for the interview which is currently about 4-5 months... it is about a 9 - 12 month process... But the Canada regional forum can give you a better ides of the wait times and any other options...

hi i think first of all you understand the whole process if in case job is terminated and your husband return back to canada

the first step you can take is i-130 petation you filed i-130 petation for your husband this is the first step for your cr1 ir1 visa process

2 step when your uscis finally approved your i-130 petation and uscis transfer your petation to national visa center this is your second step

3 and your thirt step is when nvc send you affit daffit of support and other bills to your usa maling address is up to you how fast you pay all the bills when you pay all the bill then your process begin again

4 step when you clear all the bills then nvc invite your husband home country to applay for cr1 ir1 visa when your husband fill up all the form and send back to nvc

5 and then nvc return back all document canadian usa embassy to make interview schedule with your husband

the whole process take minimum 8 to 10 month and maximum 11 to 15 month

and when your husband got visa finally and move to usa and he got his green card 45 to 90 days depend on your maling service

your story create lots of question you say in your post you already married if you are married already where is your marriage ceremony held your marriage held in usa or in canada

if your marriage held in usa why you dont filed adjustment of status how many years for your marriage

if your marriage period more than 2 year your husband status is ir1 your husband is eligible for 10 year green card

if your marriage period is less than 1 year your status is cr1

please tell me in detail then i will give you a proper answer
