filed I-751 in October 2008, still waiting

sorry to hear that you have been getting the runaround too. i have my own reasons for not wanting to become a citizen, and that will not change. as a permanent residents, i have all the rights that i feel that i need. my father-in-law isn't a citizen either, and he served in the military, he has veteran status and the benefits that go along with that. he is about to retire and will be getting social security just like a citizen would. i don't think he is missing out on much, other than voting. anyhow, that's just my opinion, i understand why others want to naturalize, and that's respectable. its just not what i want.

nycguy78, i am going to call my congresswoman today. as for writing to the district director and to CIS Obulsdman, could you explain? i am not familiar with that process, or who these people are even haha thanks in advance!

September 15, 2008: I-751 package sent

November 1, 2008: Received NOA

Januar 13, 2009: Biometrics appointment in Buffalo

May 2009: Notice of case transfered to California

August 3, 2009: received RFE letter; sent in evidence 2 weeks later, USCIS confirmed reception

March 03, 2010: Filed form DHS-7001 with CIS Ombudsman, and contacted my local Congresswoman to try to get my case pushed through.

June 5, 2010: Letter from CIS Ombudsman telling me USCIS is not ready for a decision yet. They didn't give me a timeline for when to expect a decision... this is getting worst...

August 2, 2010: Infopass appointment for I-155 stamp in my passport. Agent who helped me is going to get my file from California and process it himself!

August 10, 2010: Email from my Congresswoman's office, USCIS still not ready for a decision, told to wait another 90 days. And email from agent at local office telling me that his request to get my file was denied by California...

If you do go that route, be sure and mention it to your congresswoman's office as well. They may let the Ombudsman research before they'll get involved. Personally I'd start with the congresswoman. Only because I think the ombudsman's office is pretty swamped.

Make sure you write a letter to the district director , he or she has more authority on the case and will be able to help you in a better way

Send it certified with return receipt

What is your district office ? You can search for the exact address on www.uscis.gov and address the letter as

The District Director

Address

you can also do a search on the internet and see who is the current district director of your Distirct office , but if you cannot get that information just address the letter as above

this won't just fall into a black hole? whoever the director is will actually receive this?

yes whoever is the distrcit director should receive it , send it by certified mail ...I will post information if I get to know who is the current district director

ok so i had never heard the term "writ of mandamus" before and didn't realize this is essentially a civil lawsuit! after looking at the link you provided and reading how one user went about doing this, it sounds fairly involved, as it is a lawsuit against USCIS essentially! wow. here i was thinking i was just going to write a complaint letter to the district director, not serve them a lawsuit!

i guess this could be an option if all else fails. i contacted my congresswoman today, and mailed my DHS form to CIS Ombuldsman. so we'll see if anything happens with that first.

You are welcome , I just gave you the information in case you need it , in my case a letter to the district director , cis ombudsman and congressman helped , I sincerely hope and pray that you get your case approved soon ...

Definitely get in touch with your rep's office! Also try the Infopass. I hope they get it together for you. As you will see in my signature, I know how those long waits can eat away at you. Let us know how it goes.

Timeline

I told them about my situation. I just said that I have seen friends and acquaintances get approved in 30-60 days with no issues (some people that filed in January), and yet I have had NO updates since October. I also mentioned it should not be pending FBI namecheck since my last name is the only one in the US.

They sent the letter asking USCIS to explain the delay. Apparently when congress intervenes they can't say "wait 60 days for an update. then wait 90 days from THAT day for a potential update/resolution." they have to find the file and say what is going on. So as soon as they got the letter from the congressman they approved the case.

Just another example of a file sitting at the bottom of a stack of new applications and being ignored/forgotten about.
